WHA?!?! Why would the cop have any input? The formula the insurance company uses is pretty simple. The only way you are going to be able to convince them to total it is if you get a bunch of quotes from shops saying the damage is considerably more than what they are using as an estimate.

Wow, All I can say is people around here have no idea how the insurance industry and the body shop industry work.
I would call the cop who wrote the report at the scene of the accident and ask him/her to tell your insurance company and write on the report it is totaled. Give the cop a sob story and tell him/her the car will never run the same again.
Um, the insurance agent would tell the cop to shuvit. It's these people's job to give out as little money as possible. They are not just going to total your car because you don't want to drive it again.

At this point I would just like to see what v8k1ller says after his car is fixed. I would also like to point out that I have work in a good body shop for two years, and while I am no means an expert, I can tell you that most of these people don't have a clue.

I was told they are going to replace the entire side of the frame, re-weld to existing chassis factory points and have it within oem specs based on lasers.... I found this off google forums:

should be checked. If they have not done a serious check, which is not
going to be done at a dealer or 98% of the body shops around then they don't

I have had friends who have ended up with a better car after a frame
repair than before. Most cars off the line are not perfect and a really
good shop can put a car back to tighter standards than the manufacturing
line. They also can, in some cases, repair damage stronger than the
original.


The problem is often it is not done right or maybe not done at all.
Alast there is the possibility that some kind of damage has been done that
can't be put back right.


I am sorry I am not a frame expert, but I do know more than the 80%
group that feel any accident or frame damage is the death of a car. It is
just not so."

Just as a reference I was in what sounds like a similar accident with my car a little over a week ago.

My car was totaled (as it probably should have been). BUT, I really feel that the only reason it was totaled is because my insurance adjuster let me have the car towed to any body shop I want. When the body shop did their estimate they ended up arguing with the adjuster about whether things should be replaced or not. In the end the body shop won out and the car was totaled.

I wish you the best of luck dealing with your insurance company.

Thanks for your support everybody, but I've decided after it gets repaired to sell it, it won't be worth the hassles in the future. Getting an '07 BMW M3... currently in negotiations!
