In regards to the fluid, you would have to prove that he put the wrong grade in the car. If the grade is correct, he would not be liable because the oil is certified to meet or beat the manufacturers recomendation. For a civil suit, you must prove your case with a proponderance of evidence, so you basically have to show that he was negligent. Although we all know that DiaQueen LSD is the best oil for the X-case, you cannot hold him responsible for Redline oil of the same grade, unless you directly specified ONLY DiaQueen. (then that must be proven)
There have been many reports of people running redline shockproof or any other aftermarket oil in the xfer and it causes problems. The EVO xfer is much more sensative to oil than the DSM xfer case that most of us are used to. The fact is that even though diaqueen is factory oil, it is top shelf stuff and it doesn't pay to replace it with an aftermarket oil.
There are thousands of high power evos with high holding clutches that haven't got the whir of death. The fluid is more suspect than anything else. If the person doing the clutch didn't know to use the factory Diaqueen oil then 9x out of 10 they used some other gear oil they figured would be good enough. Even when you take the car to Mitsu you have to verify they use the Diaqueen LSD gear oil because they rarely stock the stuff. Trust but verify.
The guy doing the clutch would have had to order the LSD gear oil special and more than likely would have charged you for it since its not something most places just have on hand.
