Even if you had any chance of getting anything done about the damage which you don't because the car wasn't bought & delivered sight unseen, you have no proof the damage was pre-existing to purchase or happened after you took delivery which is EXACTLY what his lawyer would argue. Anything else has no relevance. Sorry man.
