what are my rights
The moral of the story is : always hit the deer. That applies to any nonhuman animal smaller than an elephant or a T-rex.
Screw the animal rights, kill Bambi every chance you get. The damage is generally much less and you won't have to make dangerous evasive maneuvers into guardrails/trees/off cliff edges. Just brake as hard as possible with the wheel straight (ABS + 4WD means the car will likely not shimmy) and ram that jaywalking critter at low a speed as possible.
I know it's instinctual to swerve, but it's something you can condition.

+1.. this happened to me last fall. Was cruising down the highway and a deer jumped out in front of the car. I was absolutely positive I was going to hit it, didn't swerve and just slammed on the brakes and... stopped about 5 inches from the deer that was staring back at me, then it took off.
Did he say something to you? lmao... j/k

apparently this tactic is actually safer than trying to swerve and dodging the deer itself, unless you really have a good distance and reaction time to do so.
do the police have it impounded ? when my first evo was stolen, they had 30 days to get me a check (it was set on fire after being stripped). I ended up getting it almost 3 months later becasue police were holding it as evidence for arson (you wouldnt believe the investigating they did on the car). Insurance cant cut a check unless the totalled vehicle is in their posession. Atleast thats how drive progressive is. in your case it seems the police should release it fairly quickly. I ended up calling my insurance broker/agent very pissed off and he moved things along very nicely. You should do the same
