what are my rights

totaled car 2 sundays ago, insuance is being really hard to work with.
i wanted to know my rights as far as pay off, rental car, and buy back. if anyone can help please do

you have to be more specific. was the car under your name? Were you racing? Were you doing anything illegal? Read your insurance contract, it has your right in there.

no i was not racing, swerved to miss a deer and hit a guardrail. it is registered to my mom but i am on the insurance to drive it.

dude, if you seriously want some meaningful advice , you gotta write one of those long *** stories with all the facts. and you need some pics of the car, cause it's probably not totalled. realistically, mommy has to deal with it. it's her policy.

just DEMAND what the car is worth- Just threaten them with (do I have to get a lawyer on this matter, This car is worth X amount!) do your research.
You HAVE to be firm, or you gunna get screwed!

Rental only appiles if you have it in your policy. Pay-off is determined by some magic number they concoct based on many factors. Buy-back is always an option but it's at the cost of what the insurance company can sell it to a parts yard for.

Bottom line, don't accept thier first offer. You don't have to. If you think you're getting the shaft, speak with a lawyer. Consultation is usually free. Either way you go, your rates are gonna skyrocket so in the end the insurance company gets the last laugh.

it all depend on your policy as far as rental car pay off they should not give u hard time thats why u got full coverage right?

my policy states 30 days for rental but they said once the check is sent to the bank they are not going to cover a rental car, so technically i have only 2 days with rental car. they filed it under collision instead of comp because i did not hit the deer, which means higher deductable and 1 point on my driving record, i found out today the car was picked up and shipped to sacramento and my mom did not release the car, just today did we get the papers for pay off and other stuff to sign for. the insurance said that the paint was faded and all scratched, the leather was cut in 3 spots, and the carpet was soiled. they are some other items that they listed. on top of that they gave me only $200.00 for all the options such as leather HIDS and sunroof. the car was just detailed a couple days before the accident, heck I was in the car yesturday and the interior is just dusty from being in a shop. as far as the paint goes the passenger said which has no damage looks brand new. does any one know of a good lawyer. also we have to still contack mitsubishi because the air bags malfunctioned. here are the pictures of the car

ok, first off "mommy" does not fly with me, it's cool that you have advice but your advice has nothing to do with my question, with over $22,000 in damage i know for a fact it is totaled, but if you think is fixable i am more than happy to give the car to you and you can get it fixed. O.K.

Ha, what kind of insurance company is this? Fly by night one? Man I avoided a deer and did some damage to my car. Allstate cut me a check for all the damage the next day and paid for a rental for 50 days no questions asked, no hassle.
