if the dealer will let you buy it back then give it back to them for selling you a
beaten evo. how much did you pay? if you paid cheap then it is for a reason. if you still want to buy despite that then let the dealer fix the TC and warranty it. of course the price should be cheaper.

I paid 15k plus my audi, certainly not cheap. Its warrantied but its always gonna be in the back of my mind, I think I may have to spurt a tear and let her go tomorrow
Why would you even consider keeping it? Unless the dealer will replace the TC and the rear shocks with OEM or better parts, why are you even debating this? Give the Evo back, get your trade in, and go somewhere else. There are loads of Evos on here alone... Just sell your car privately first. You should never trade a car in anyway...

I've seen t-cases fail in cars that weren't really beat on but where incorrect fluid was used. There's always the chance that the previous owner new the tcase was failing so they traded the car in as well.

These cars were built for fun and you gotta pay to play. It's just too bad you weren't the one to have fun with it first. Sorry man.
If replacing a transfer case is giving you problems right now; what's going to happen when you need to do the clutch, syncros, timing belt?
If you can't do stuff for yourself, then count on spending a lot of money on this car. It's just the way it is.

if it was me in your current situation I would take the evo back and let the stealership give me a new TC.
Get a leak down test and a compression test.
if everything is fixed then you'll be gravy. Just take it easy w/ the evo.
You can't dump the clutch on the evo. You have to slip the clutch (For future abuse on the vehicle) The guy who previously owned the evo more than likely dumped the clutch therefore breaking the TC.
I say give it back because you have already lost confidence in this specific car. The idea is in your head that this car was abused, and whether it does or doesnt you are always going to be waiting for the next thing to break. More than likely it will break though, and it will be expensive, and I would say send it back and start over. If you keep it, and it just keeps giving you problems, you are totally gonna lose your a** when you have to trade it in in a year or six months.
