ok good, because i took of my heat extractor, so now you can see into the engine from the outside and see my intake
but itsnot like right under where water can get in it, its like next to the battery

You live in a place that sees very little rain. I personally would never expose the filter directly to the weather....if rain can fall onto it directly, or drip on to it from the hood, then large amounts of water will enter the system. But it'll probably all end up at the bottom of your intercooler, reducing the efficiency of the system.
That'd probably be a good idea. You're in Vegas though, what do you care? 
Either way, I don't think you should have to much to worry about.
If you're concerned about it when you're about to give the car a bath. Just put a plastic bag over the filter while you're washing it.

vegasboy. What I was saying was that if the water drips directly onto the filter from the hood scoop, you will take in some water....whether you are driving or not.
But it probably doesn't drip directly onto the filter, unless it is a VERY short intake tube....so don't sweat it.
btw, I drove my Evo through 80 miles of rain, sleet and snow.... complete with slushy 4 inch deep puddles and street snow pack.
I had no problems with the AEM intake.
