Claiming city for damages.

So I have had my evo 8 for a couple of weeks now and have had nothing but bad luck with it so far. What really takes the cake though is this...Parking into a stall downtown most are on a slope so rolling forward is quite easy. Only one stall was open and I go to park in it only to just notice a massive pot hole right before the curb about two feet out from the curb. I parked right before the dip but putting my ebrake on and leaving the car lunges forward. (Silly me, forgetting about the slope). The car sinks in and is driven into the curb ripping my front lip off. My question is....can I claim the city for this or am I going to have to pay out the ***?

A new lip is like 3-400, and finding a used one is quite hard. A carbon fiber lip is cheaper if I have to paint it too..I might just order a front bumper/lip molded in still deciding though.

Just get a new lip. They might say it's your fault. Let others chime in.

First thing that needs asking is. Is this city property or private property?


Other than that they will say your equipment was faulty I am sure, since as you claim the car moved forward befor the brake grabbed.

You could try, but I say just eat the damage and learn from it.

Well if you can why not try. It never hurts to try, there is significant scratching to the bumper which touch-up paint can't cover. Just gotta decide what lip to get if not a whole front end..

Just get a Do-Luck style poly urethane lip, get it painted and be done with it. I have this same exact lip (except mine was from a different vendor) and the fitment isn't all that great but it looks good. I scraped this against the ground plenty of times and it's pretty durable.

S*** happens man, you're most likely gonna have to pay for it youself. You could try argue the city for not filling the pothole since it is their responsibility.

I'm not saying don't do it, but if a decently priced lip cost a few hundred dollars just try and think about the effort your going to have to put into filing a complaint, possibly a lawyer who usually don't work for free, I understand it's all about the principle of the matter but sometimes it's just not worth the aggravation and time you'll have to put into it.

Also, next time remember to leave the car in gear AS WELL as put on the ebrake.

But yeah, good luck with getting anything from your city. The entire motorist community in Salt Lake have been trying to push for the city doing something about the potholes and construction related damage (namely rock chips) for years and they just have loop holes to get out of it all.

you will end up paying for it your self, dont bother with the city. At best they will send you a letter stating the same, and just in reading it you would have wasted your time.
