Did this and got boned... Use YOUR INSURANCE company. They(your ins) have your best interest in-mind. They will charge back the others. They will not nickle and dime you. You pay them, your their customer. The others insurance co. are just looking out for their bottom line at the end. Call your agent and make that claim. Trust me on this!

I hope you had the police involved. I'm not sure if Florida is a "no fault" state, but either way, it's best to get an accident report so it's not a he said, she said game.

Also, as what was stated already. Go through YOUR insurance company. This should have been your next step after you got home. They can start the paperwork needed, and get THEIR OWN adjuster out to inspect the car. The Ford owners insurance will also send out and adjuster, and you'll be surprised on how different those numbers will be.

Good luck man. Sorry about your Evo, but it's just a car. Just be thankful you didn't take the impact in the driver door, or you could have been spending the night in the hospital, and REALLY had some legal issues.

Best of luck!

S****y man, though if you were paying somewhat attenion to your surroundings you would of seen the truck attempting to shoot the gap across 3 lanes and you could of accelerated a little like any curtious driver would and avoid being hit, but unfortunately that wasn't that case. Just sayin'

Who is the other guys' insurance company?

If it's someone that doesn't suck like USAA you might not need to involve your insurance co at all.

He still has to go through HIS insurance. You deal with your insurance because you are covered no matter whos fault it is ( Assuming you have full coverage). Your insurance pays you for the damages because you have collision wich means your covered even if its your fault. THEN if they detemine your at fault you get points on your license. If they determine your Not at fault, they seek to get reinbursed by the other persons insurance and you get no points on your license.

The other reason is because as other already said, the other insurance is looking out for their best intrest. EXAMPLE: one time I got rear ended by someone on their cell phone. It wasnt a big deal I was not hurt in any way and the other persons car got wrecked under my highlanders rear bumper but all my bumper had was a scratch. Any ways the other persons insurance called me immediately and offered to have my car looked at by THEIR adjuster and send me to THEIR list of body shops, all inconvenient to me. A few days later a guy comes to my house fom their insurance, to offer me $400 in exchange for signing a waiver preventing me from ever suing their company or their client for personal injury on this particular claim. They did this because they knew I could of filed a pip claim and got them for thousands of dollars. I took the cash because I wasnt going to sue anyway. But I did call My insurance who let me go to any body shop I wanted and then got reinbursed by the other company.

Sorry for the long example. But it does demonstrate why you always go through your insurance company no matter how good and helpful the other persons insurance migh SEEM to be.

Most definitely call your insurance co! His insurance company will try to low ball you as much as they can get away with because you aren't their customer.
I doubt they will total it. Looks like the suspension soaked up most of the impact. I'll bet the est is around $10K...

Been in a few accidents myself. Definitely get a police report. I would only call your insurance. If they total your car, you can buy it back super cheap and sell the parts. I did that with my Z28 that was wrecked. Hope this helps.

It's sucks. Sorry to hear that.

I didn't have to claim thru my insurance when i got in accident. It happend to me 3 times, and it was all other's fault. Only one case, i had to go thru with my insurance. Just because other insurance company tried not to pay me much and i needed extra cover incase.

Good luck, your best bet is ask your agent about state law before you claim thru yours. But if you don't need to, try not to claim thru yours.

i havent read this whole thread so im jsut going to reply to the OP

i recently got hit as well. it was 100% his fault. I tried going through his ins. (liberty mutual) and after giving my statement they said they had to wait on the police report. I got them the police report 3 days later that backed my statement 100% as well as gave them my witness name n number. They said they needed a statement from the other driver. They say they have conflicting stories and denying my claim. I told them that the police report backed my story, i have a witness yall didnt call, i even have a recording of the guy admitting fault and they just wouldnt hear it. I ended up just having to go through my own ins (state farm) and they're taking care of it. Much easier as well. State farm agree its the other guys fault, so they'll b suing liberty mutual for the funds.

Important info:
take as many pix/recordings and notes as possible. I caught liberty mutual go back on their words a couple of time because i took detailed notes of every conversation (date/time) that i had with them
