I think I will consult a law firm just see what they think. My girlfriend is actually going to law school next year and was an english major for under grad, so she can likely help write a letter that sounds well versed!
Hopefully I can get this thing replaced and really enjoy the car.
One last question for you guys. As I mentioned, the car was vandalized not too long ago. It still has the dents as I haven't had much time to get the car into a body shop.
Should I hold off in getting it fixed as the car may be getting replaced? Or should I just get it fixed and go forward from there with trying to pursuing the Lemon Law?

Forget about fixing it bro... the car is a Lemon... the issue is the brakes, not the door dings... they can't give you crap for that... they shouldn't give you crap for that

I've had a 2010 Evo X SE since December and I just started experiencing the 'Brake System Service Required' warning flashing on while driving.
It happens intermittently usually just after start up. I hear a click in the lower left of the dash, the stereo turns off, the tach turns off (goes to 0), then it all returns to normal in a couple of seconds. I still have power and brakes. I haven't taken to the dealer yet because it just started a few days ago and I can't reproduce it nor predict when it happens (which sucks to ask the dealer to diagnose phantom symptoms).
If I find anything out, I'll post it.

Mine is somewhat different. The first start of the day won't produce the warning. Every startup there after however, will. (for the rest of the day that is). My stereo never turns off or anything like that, but it is discouraging.
I hope I can get an Evo that doesn't have problems.

mine just started this problem too, at 4500 miles. Car drives just fine. The light turns on only when i'm accelerating though.... guess i gotta get ready to take it to service 6 times then hire a lawyer, ****nuts
Yours is probably low on brake fluid. There is a sensor that regulates how much fluid is in the resivour. When you go to WOT, the sensor is probably tricked by the "sloshing" fluid..
Yeah, I've had that. As your pads wear down you need to top off the brake fluid a touch. It doesn't have to be very low to trigger the slosh effect, like maybe at the bottom of the line on the res. Add a little splash and see what happens...
+1 I've had the brake and abs lights come on due to "sloshing" low fluid levels that when the car is at rest is above the minimum fill point on a 93 Escort GT, 05 Scion tC, and once on my 05 STi. It happens, and happens when pads wear a bit allowing the fluid to fill the calipers a little more
I topped off the brake fluid during lunch, it worked fine and the light doesnt come on anymore. makes sense that it was sloshing.
My question is, (forgive me if i'm taking over the thread) WHY was my brake fluid low at 4500 miles?? do the pads normally wear down enough at 4500 miles for this to occur? or do i have a leak?

Ya I would contact a lawyer about lemon law, that's BS that the dealer is returning the car to you unfixed. How far up the corporate mitsu tree have you barked? Have you taken it to multiple dealers? Mitsu dealer level of service isn't very consistent, if it's an option try another location. The smell is normal, it's not clutch but something like a body protection spray burning it off. I notice it several days a week after my 20+ mile commute to work. I'm over 10k miles now and I notice it less. Should go away with mileage/time. Best of luck, I hope it all works out.
