Unhappy What to do? 2011 Evo X

Hey guys,
So, I've posted only a few threads on here since I bought my Evo X. (April 12th, 2011) So, three months down the road and I'm not sure what to do. The Evo has had a warning light on since I drove the car off the lot (well the second time I started it, leaving a friends house actually) that reads "Brake system Service Required". It displays that along with the actual red "brake" light being on. It has been into the dealer around 6 times and is yet to be fixed. They thought they knew what it was (ETACS) or something of the sort, but this did not end up being the case.

The car still performs as it should (I believe), but it is very discouraging every time I get in the car. I hate seeing those lights on. It's a brand spankin' new car. This should not be happening.

Also, I have been driving a standard transmission for around 6 years now. I am baffled, but every time I get out of the Evo, I smell burnt clutch. I'm not launching it/riding the clutch. Just driving her for normal everyday tasks. Disappointed.

Next, as some of you may have read in another thread I made, my car was vandalized about a week and a half ago. I got about $1500 in damage (dents and some paint missing)

Obviously vandalism could happen to anybody, anytime. That's what I'm most nervous about however. Was this a random act of vandalism? Or was I targeted? Did I **** somebody off? (I don't drive this car like an asshat. And it's not an EX or anything like that as I've really only been with my current girlfriend for about 4 and a half years now.) There is another WW EVO X owner that lives in the area where my car was vandalized. Maybe he pissed someone off and they confused our cars? I will never know. I don't want it damaged again though.

So what to do? I'm concerned about this car. Even if the brake problem does get fixed, I feel I will always be nervous about modding the car and voiding warranty. I bought this car to do a bit of modding. I know I know. "Things could go wrong with any car after modding and void the warranty..." But I'm starting with a platform that already has something wrong with it.

Sorry the post is soooo long.

I'm looking for some advise here folks! What would you do in my situation?


I'm pretty disappointed with the car right now.

I love the community though!

6 times and it hasn't been fixed?

Can this be thrown under Lemon? get your car replaced?

6 times and no fix... wtf!

From what I've read about Colorado Lemon Law, you must own the car for 12 full months and the car must have been to the dealer 3 times for them to attempt a fix.

Doesn't the clutch and brake use the same fluid (I'm not a mechanic...so correct me if I'm wrong). I would top off your break fluid just to see if that helps.

6 repair attempts is lemon law material. There is a federal lemon law which should apply here:

Bring the case to a lawyer. If you have a lawyer watch how fast the dealership moves to replace your car free of charge.

After doing a bit more research, Colorado Lemon Law states that I have to have 4 attempts in a one year period.

So, all appears to check out there.

I will be looking into all of that! Thanks for those of you who responded so quickly!!

Has anybody had any experience with a lemon and handling it?

Is it best to go ahead and do the paperwork yourself or get a lawyer involved?

Regarding the 'clutch' smell, I have read a lot of posts where this has been mentioned and I personally thought the same thing when I bought my X GSR (2months ago). I believe that it is protective coatings (or some sort of fine layer) burning off parts in areas where the engine gets very hot. Im sure a lot of people will agree with this as it does seem very common.

In regards to your brake light issues, I would kick up the biggest fuss. I would leave with a brand new car and if the dealer didnt have a new one i could take then and there I would demand a car of my choice until they can provide me a brand new car. It always shocks me the audacity of car dealers. You hand of $35,000+ the least they could do is give you a car in perfect working order, but we would be lucky to even get a smile!!

Get mitsu na involved. Go to the dealer and don't accept the car back until its fixed. Don't be a complete ******* but don't just lay down either.

This is all good advice. Get Mitsubishi north America involved and get the gm of the dealership involved and make sure you have copies of all the paperwork. I had one car replaced under Texas lemon law myself years ago... It was a range rover. It's not hard the law is on your side.

I'd get a lawyer. It's a $35k car and I bet a lawyer could get things moving with a few phone calls and/or letters for not more than $1k, probably half of that. At least give a lawyer a call to get some advice.
