Since your car is pretty much brand new... Go with lemon law and dont worry about the rest.

If it was a year or so old and you had this problem, it would have been your brake pads/fluid. At least that was my problem, I started getting the brake service required and getting pad/fluid change on Saturday

Unfortunately I've been so damn busy at work I don't have much of an update. I haven't even really driven the Evo since the last time I took it in (about 2 months ago). Put maybe 300 miles on her. Still having the same problem.

I am scheduled to have them take another look at the car, next week it looks like. They want to keep the car for several days to try to fix the problem.

They claim that they have never seen this problem with another Evo.

So, I'll update when I get the car back sometime next week. I suppose I will start the Lemon Law process.

If there happens to be any Lawyers in here especially Lawyers in Colorado, I'd love some advise on how to get this thing rolling. I'm just so bummed out. I bought a new car thinking, nothing will be wrong with this car, I don't have to worry about how someone else drove it or if they modded it. Just plain sucks.

It's party my fault it's taking so long, but my schedule sucks right now, so it's gonna have to wait.

Thanks for all your replies everybody.

You guys talked about topping off your reservoir. Was it at all low when just sitting on a level surface? I might as well top it off and see. Mines been doing it since day 1 though.

*TIP* Look up past threads with Webman. He had major issues with his Evo and went through a legal process in Colorado. Perhaps he mentions his lawyer in some place???

Thanks in advance guys!
I went through this years ago with my girlfriends Hyundai Elantra. We had bought it brand new it and was experiencing a stalling problem. Without getting into specifics, it was a dangerous problem and needed rectified immediately. We had taken it into the dealer 4 times for a fix. Each time they assured us they found the problem. The car continued to stall. Knowing what rights we had, we contacted an attorney that specialized in Lemon Law cars (looked in the phone book, no joke). We met with him and he explained that different manufacturers handle things differently. Some you have to go through an arbitration process before getting the ball rolling in court. Hyundai was not this way however. Basically what happened was the attorney filed with the court, and the court decided in our favor. We didn't spend a dime and didn't step foot in a court room. It was as painless and as easy a process as you could imagine. It did take quite a while for the whole deal to go through though. Took about 6 months if I remember correctly. When it was finally time, we took the car back to the dealer we bought it from, handed them the keys, and they FULLY refunded us with a check that covered tax, title, registration fees, and all of the payments we had made since the purchase. We walked away with nothing out of pocket, and drove that car for nearly 18 months. I'm not saying it will be that easy for you, but it is certainly worth checking into. Mind you this was for an $11k car. I'd be PISSED if I was dealing with that type of thing with a $40k car. Good luck.

I feel your pain. I'm so nervous about my Evo. I'm forced to park outside since my Dad hogs the garage with his BMW 750 Land Boat and his freaking 2 motorcycles and my brothers Ninja 650. So my car is exposed to all the elements plus ******ory teenagers who love to vandalize things for fun. I already have a dent on my drivers door. Sucks being paranoid.

The Evo has had a warning light on since I drove the car off the lot (well the second time I started it, leaving a friends house actually) that reads "Brake system Service Required". It displays that along with the actual red "brake" light being on. It has been into the dealer around 6 times and is yet to be fixed. They thought they knew what it was (ETACS) or something of the sort, but this did not end up being the case.
I had this exact problem when I first got my Evo a few months back. The dealership here replaced the master cylinder(said it had something to do with a sensor) and it hasn't had the light on since. Did they try this approach yet?

ik this is late, but i had a buddy that had a friend with a gsr and his clutch went super fast, he later claimed lemon and got a new evo. idk i have heard this with the gsr. but not at all with the MR. I have an MR my self, its great for everyday driving, and with sport and s-sport mode, spirited driving is amazing! if you are able to claim lemon get a MR if they let you. i hate to hear lemon law called against an evo tho

this same thing happened to my brand new evo. Turned out to be the master cylinder leaking break fluid. The brake sensor light comes on when the fluid is low. They had to order the part from japan and i had to wait a couple weeks, but they fixed it.. i would take it to another dealership
