Accident
Had a guy clip me once he was backing out of spot not looking. We swap info, he was elderly so I figured I have his info, he admited fault I'm all set.
Not exactly, someone must have told him to say he was backing out but stopped & I hit him.
Wtf he was a little old my trying to beat me for a nice chunk of $.
Had to sue him in small claims court, he got caught lying to the judge so he screwed himself. moral of the story he fit caught bs.That was the biggest hassle over $1200 damages.
Sorry for the long response, just you got to call the cops when things like this happen or it's he said she said.
Before court his ins co offers $600 half of the damages, no way. I had just gotten a 2008 g37s didn't even make a payment when this happened.

As has already been said, most states have a minimum damage level above which you must report the accident. The time that you have to report the accident varies from state to state, as well. When in doubt, you always report it.
I talked to the guy who caused the accident via phone today, and planned to record our conversation. I told him i am making sure that he caused the collision and ran the red light. He admitted it. I told him i am not allowing the insurance to pay anything out of my pocket. He said don't worry about it, their insurance will take care of it. Their insurance will contact my insurance and will also call me. I used my gf's call recording and we got his statement admitting it.
Just in case he flip over which i think he won't imho. Now just waiting for tomorrow to talk to my insurance again and start fixing my lovely evo and back to the road.

Did you obtain his concensus to record the call? In many states (and I'm thinking Ca is one), if you don't have his approval to record the call your recording is worthless. http://www.citmedialaw.org/legal-gui...-recording-law
ALWAYS call the police, even if it doesn't look severe. I had someone back into my Audi S4 once in a parking lot and it looked like a minor scrape in paint, no big deal right? Once the bumper cover was off for repaint we found a bunch of broken items like the HID frame, etc, ended up costing $4k to repair it all.

Unless you have him agreeing to be recorded, you CANNOT use that recording against him in a court of law or with the insurance companies. Did you start the conversation by saying something like "I would like to inform you that this call is being recorded, is that OK with you?"
He's in CA. He cannot just inform the other person that the conversation is being recorded. He must get consent. If he made a recording without consent, he should delete it immediately.
