You 'can' but it depends on how aggressive the intake is. Usually a drop in filter is ok without a tune but a full CAI replacement I would tune. That being said, I prefer to tune for anything that changes airflow in a turbo car. Why risk it?

If this is a brand new car, drive it for a bit, get used to it, then when you know it is solid decide if you want to take it in to get some more power.

If you do, get in touch with 5150 racing in CA (one of the best in the business) and discuss with them your goals, and let them suggest parts and get them to pro-tune it.

Turbo based cars are very different than cars like a Mustang when it comes to modifications. 'Unsupported' modifications that aren't backed by a proper tune can lead to big problems.

Hope this helps, enjoy the car!

P.S. You can add an exhaust (catback exhaust not downpipe back) without tuning. That would make it sound a bit better if you wanted, without voiding your warranty.

I was planning on getting the k&n typhoon intake along with the intercooler pipe but if cat back exhaust don't void warranty then I'll probably get that done so it can be a little louder

Living in CA I suggest you be careful in choosing your mode. You want to keep it stealthy and also make sure the intake that you're going to get is CARB approved. San Diego may be a little far for you but Road Race Engineer is another shop that you may want to call or visit regarding the Evo. The intake does mess around with the car air/fuel so it's best to get it tune so you may want to do it at the same time with getting the exhaust. You got one of the best performance cars for the money. Enjoy it.

I do live in San Diego and if it's not carb legal I'm okay with that lol I would just switch it back every time I visit dealer for 15k intervals but thank you guys for the advice I'll just buy the intake and catback at once and get it tuned when I go install it.

It's not the dealer that you need CARB legal, it's the popos that you may have to deal with. Been there done that.
