also, when we got the junk yard i figured the header was going to be trashed because the radiater was smashed into it, we pulled the radiator back and it had bent against the header but the header hadn't bent at all

I would definitely call back your insurance company, and tell them when you're going down there and they NEED to call while you arrive. Personally, I would have handled it this way: Oh please oh please, mr wrecknig yard guru, pleasae, lay your hand on me one time so I can rip your arms from their sockets and not go jail for it. (then again, I'm certifiable... so...) besides, when all else fails, that's what shotguns are for.

def call your insurance company immediatly, id also call the cops ahead of time and have them come with you seeing as he threatened you the last time, tell the cops you dont feel safe and want an escort, he then cant say **** when youre there.

That's kinda ****ed up. This kid and his girlfriend could have died.

Call your insurance company and have them follow up, then the local PD is definitely a good suggestion too.

I had my friend read this thread. He's gone to many a yards and this is the first he's ever heard of a manager doing this. "very unprofessional" is what he said. Take the cops. Get your parts!

yeah, then it would be different. But they didnt.

I am a claims investigator for numerous major insurance companies as well as 3rd Party Administrators and trial lawyers, so needless to say I deal with this often.

The salvage yard has no right to kick you off his property, unless you were there without his permission. That car is technically still yours and he is just holding it for you until your carrier salvages it out or settles with you. Have you settled with your carrier? I am assuming not since you said that you have spoken to the carrier about your parts.

I wouldn't even bother with the parts though. As long as you have proof of purchase for those parts and you can clearly document that they wereon the car at the time of the accident, you carrier will reimburse you for those parts, regardless if you reported those parts to them when you initially installed them.

When you settle with your carrier for the Actual Cash Value of the vehicle they have to take into consideration the aftermarkets parts when evaluating the car. Think of it this way, when they settle with you they are essentially buying your car from you. They will in turn sell the salvage of the car to a scrap yard or recycling facility to get back some of the money they paid out on the claim.

That salvage yard owner had no right to come at you like that, unless you were there without his permission. He can threaten to call the cops all night long, as long as you were there with his permission and the vehicle is still yours. It may even be beneficial to have the cops there to calm that idiot down.

FYI - Your insurance agent can't to crap for you reg. the salvage yard or the claim for that matter. You would need to speak to the claims exmaminer handling the matter about anything. You could report the incident to that person, but I am not sure they would be able to do anything unless they use that yard often.

Thought I would give you some advise as most people do not understand the inner workings of the insurance business. They are alot of options available, you just have to be aware of them.

Untill the insurance comp has sent it to an auction and it got sold to a dealer/junkyard, they have no right to take stuff off the car.

As a matter of fact CALL THE COPS ! It's your car still.

Actually, once the insurance carrier has settled with the owner it is there car, regardless of whether or not it has been sent to an auction or sold to a salvage dealer.
