how does a seal break by getting on the car? if he wasn't tagging the redline it sounds like it would have eventually happened anyway. i'm not flaming you, but it didn't sound like he was abusing the car. but maybe there's more to it than i know. sucks though the guy didn't listen to you. like the other guys said, i would have gave him the beat down.

My father (an insurance broker) 's take on it: Depending upon your state law you're most likely SOL. He's licensed in NY and NJ but doesn't know about AZ specifically.

Girlfriend (law student) 's take on it: pending.

EDIT: I think my father's response was assuming you could not successfully sue however. I think the destruction of private property thing is quite possible from a logical standpoint (but since when does logic play a part in American law and justice?). It may be an uphill battle, but you may be able to win with better representation.

have you contacted the police? yes you gave him consent, but you didn't give him consent to race the car and eventually break it, you also told him to stop and he didn't.

to me, it's similar to any other case where you were to let someone use something of yours, something like using it with proper intentions. like if you let your neighbor borrow your lawnmower, and he tries to mow his roof with it and it falls and smashes into pieces....i believe he is responsible since he didn't use it the way it was intended. you loaned it to him to mow his grass, not his roof.

IMO you definitely have a case. i'm not a lawyer, i'm an engineer, which i guess makes me 10x more logical, which as hobie said, the justice system is just full of illogical bull**** artists. no offense to any lawyers.....

I may be possible to really screw him and get a hold of his insurance company. Since he was driving your car, his insurance covers him in what he drives. At the least, tell them you want to make a claim because he was driving your car and street racing.
They'd love to hear that.

I would have reached over at the start of the race and shut the ignition off or something. What a freakin' *******.


Edit: Then again when you take a dealer's car out you are responsible for it. Why should a private sale be any different.
I think the police is a good place to start.

Looks like it's going to be $3000 and take about 1 month or so to get the car back. I do have to say the guys at Intense Motorsports and Rotary Performance(RX7.com) have been great. This would have normally cost me around $5000 but under the circumstances they worked with me. As far as the police no crime was commited that can be proved. It's my word against his, especially since the driver of the skyline took off. As for a lawyer this amount falls under small claims court because of the amount so no lawyers would be allowed in the court room. Also again proving this is next to impossible, so it comes down to the fact that I learned an expensive leason, and not to be so trusting with my car because there are people out there like this guy. Let this be a lesson to all of this, no test drives until cash in hand.

Girlfriend said the same thing. You're SOL. Wish it coulda been a better response. Good ole justice. Just hope that Karma exists and move on slowly, painfully and broke. Best of luck to you.

yeah someone did that to an old car I had a blew the engine so I took a crowbar to his windows and blew his tires out with a screwdriver.. his wife was crying, that is all the satisfaction I needed. (the car was only worth 600$ so whatever)

u gave him ur consent to take it for a small spin, not to race. and u did in fact tell him to stop and back off and he did not, so technically he broke ur consent, and hence, i believe u are able to sue his trailor park ***.

That sucks big time man....when the guy started to go at it with the skyline...i would have said what the hell do you think your doing?? It's you car, isnt it? You shouldnt have let him do that and made him stop. Anyways...hope it works out for ya
