MN area Evo Owners CAUTION
My dealer informed me yesterday that they have one of their serivce people go to the track in Brainerd and if any Evo's are there he takes down vin numbers and has them ran and gets the waranty canceld. And i did aruge with them saying that is not legal and what not but they said they could do it. I was very angry to hear this but i guess there isnt alot you can do about it if they are that serious about this, so just a word of caution try not to go and race there.
I did not take delivery of my EVO yet (coming in July) and am not a lawyer, but I do stay at Holiday Inn Express once in a while ;-). Does it specifically state in the factory warranty that once you buy the vehicle you are not allowed to have fun?
First, just because you were at a racetrack does not mean you were racing. Second, I do not think warranty can be cancelled by a dealer. They can certainly refuse to fix a part under warranty IF they can prove BEYOND a reasonable doubt that specific failure was caused by either a modification or improper use of the vehicle. And if you've seen an EVO VIII brochure, racing is NOT an improper use of this vehicle ;-)
Next time you see the guy at your dealer who told you this boldface lie, - BTW, which dealer is it? - tell him to make sure the service guy he sends to the track to enjoy the proceedings to brings the beers - for the spectators, of course ;-)

Thats what i told them, i asked does it say in the waranty that you can not race your car, and obvioulsly it doesnt but yet they still argued, i said what the heck do you think i bought the car for, oh well.
Urghhh.... that's too bad. Yet another "bad faith" dealer.
It's pretty lame, because smooth, 8/10ths driving around a track at say a driving school is far less wear and tear on the car than the guy who drives around town doing clutch drops, donuts, shifts like a moron, etc. Almost like they're encouraging us to drive like in the commercials on public roads instead of in the safety of a closed track...
I'm wondering at the legality of this, although I'm not exactly standing in line to be a guinea pig in a "test case"...

I bought my car from Metro (Bloomington). They know I take the car to the track and they don't have a problem with it as long as it doesn't go on the warrantly claim and we talk about it in hushed tones.
I am sure that if you wanted to persure this matter then it could be considered an invasion of privicy and a laywer would love to hear about it! Try the laywer helping out DR_evo?
I haven't read the warranty, perhaps I ought to?? But I am sure that is doesn't state specifically that the car is not allowed on a track. However I can imagine that it has words to the effect of "normal use", where anything that doesn't fall into the "normal use" category will not be covered by the warranty.
