I would get a copy of the police report and review what it says. Is the other party who claims he/she felt 2 impacts consistent with the report?
Who does the report cite? Also vehicle apprasials of all 3 cars can be used in an accident reconstruction to help your case, but this will cost you.

Is WA a comparative liability state? Seems like it is since they are trying to apportion fault to you.

If the report only faults the guy behind you, i would state your position on liability in writing to your carrier based on the report. If this is the case you may have a bad faith claim against your insurer.

In the context of the thread: you don't want to be rear-ended by someone with the same insurer as you. How to lessen that chance? Choose the agency with the least amount of policy holders.

You know what they say about having to explain the punchline...

Yeah, that is a long time. Sorry you've been without your car. Also, Allstate sucks too. I have Pemco, by far the best around in my opinion. Then again, doesn't necessarily mean they will take you. They are picky. When Allstate screwed me over, by stopping paying my medical bills, they were MY insurance company, and the other idiot hit me, I got stuck with medical bills and ended up having to go after the person who hit me. It really pissed me off, cause I hate the whole sue happy thing and didn't want to sue, but didn't have a choice. Anyway, after dealing with all that drama between lawyers and everything, even the lawyers said the best one around is Pemco, and these were lawyers for myself and the person I got hit by who was with State Farm.

damn i feel ur pain.. i got in the exact same situation 3 days before i left the country for 7 months.. i JUST got my car out of the shop after 3 months, and had to come out of pocket over a grand... definately gettin a lawyer when i return to the states

So i got the evo back about a week an a half ago...so far seems to drive great the real test will be this spring at the track and autocross tho...total cost for the damage was $22,000! i ended up going to court for the citation for following too close and i got that easily dismissed and it turns out the cop messed up and made two different police reports for the accident and the one that the court and insurance recieved showed a diagram of only me and the car in front of me, nuthing about the car that had rear ended me first...so now the real fun begins with the lawyer and the lawsuits...but on the bright side check out the new dry carbon fiber hood i got out of the deal its pretty sick!
