Rear ended by an idiot!

So way back on august 30th I was out crusing around and traffic started to back up pretty quick on southbound 405 just before the I-90 interchange so I hit my brakes and come to a stop and then 2 seconds later I get hit HARD from behind by this idiot in a RX-8 who wasnt paying attention and the force of the hit pushes me into the car in front of me. So the state patrol comes and does a collision report and the collision report shows that the guy who rear ended me got the only citation out of the whole accident. I get my car towed to the body shop and the estimate is crazy!!! $18,000 damage!!! The guy who rear ended me slid underneath my car and hit me so hard that he bent my rear frame rails and bent my exhaust 90 degrees right at my rear diff. So when I go to call my insurance company they tell me that they are finding me 50% liable only because the guy who was in front of me says he felt 2 impacts. Turns out the guy who rear ended me has the same insurance company as me so they're not willing to contest the decision against themselves so I'm getting screwed. I told the adjuster that there was a collision report showing that he got the only citation and the adjuster said that they normally dont go off the collision report unless there is a dispute! hahahahhahaha! AND the insurance company never even gave me a rental car and i've been without the EVO for 2 1/2 months now haha this whole situation shows how shady insurance companys are!!! Now i've got my lawyer involved so we'll see where it goes from there and I should be getting the evo back by the end of this week. dang bro sorry to hear of the difficult situation! glad you are ok! what is the insurance company so we know who to avoid? i'll check back in a little bit and see your "part-out" thread

hate those shady insurance company
u need to get a reputable one though...
but 18000 is really very expensive
should the car be totaled if the repair cost so much??
can u give in detail whats the repair is for
i still cant believe the damage it does took 18k to repair it
doesnt seen that serious to me

haha no they're completly sane "hahas" for sure

but yea the insurance company is liberty northwest and they are really unorganized with the whole situation...it took them 4 weeks just to get back to me on the decision they had made back on the first week.

and the reason why it was $18,000 damage is because they replaced the whole floor pan an rails, front fenders, radiator, intercooler, replaced the whole radiator support, exhaust system, C/F hood...it was a big mess! from the pictures it doesnt really look that bad at all haha.......and apparently the reason why they didnt total it is because the insurance said that the car was still worth $25,000 i have no idea where they came up with that number tho!

Good to hear that you are able to look at this in the big picture known as life.

I thought insurance would consider 40% of worth a total? Weird. That $25k price probably came from retail KBB is my guess?

I HATE insurance people!! I' got screwed when my car (years back ) got stolen. I had Nationwide back in Cleveland. Nationwide is NOT on your side. Good luck man...

That sucks man. Yeah that interchange is messed up because I notice that people try to switch into the 90 lanes as late as possible, except they slow to a complete stop in live lanes which cause these type of brake ups. I hate to see it happen and I try to look back when it does to see if the idiot with the latte behind me has noticed the backup yet....
