Head on collisions happen pretty much when you don't look at all. And yes, I do believe it was the drivers fault.
Rear End Collisions/Side Collisions - Not your fault: Can't control someone plowing in to you from behind or from whatever angle, however you *CAN* be aware of your surroundings and avoid "accidents" if people just pay attention.

Accidents are avoidable, but looking at the from the trucks point of view, he also was in an accident. This wasn't merely a crash for him, he was in the path of a kid who couldn't handle a text message while behind the wheel. Now you say that being alert and aware would mean that he would have swerved. What if the Evo driver looked up last minute and swerved to the same side of the road as the truck (assuming the truck swerves to "avoid" the crash)? There's a head on either way and now the truck is also at fault.
I am not defending this kid. To say that he deserves a head on is going too far, though. If you truly believe he deserved to be in the hospital, I hope you trip while running with scissors and stab yourself in the face.

Yes, it is unfortunate he is in the hospital. But I have no pity for his actions.
If I crashed and totalled my Evo while driving and texting, I wouldn't expect sympathy from others, its my own damn fault. Its worse that he had a suspended license and no insurance as well.
That driver was irresponsible to the point to where he got himself in that situation, and there is no one to blame but himself.

This should have been introduced BEFORE the hands free talking law. Hands free talking has lead to MORE people texting while driving. At virtually every light I see people grab their phones and start screwing with it. To me it's a lot safer to hold your phone and talk than it is to text (i'm sure everyone agrees). On the same token I think there are a lot of people out there that CAN'T handle talking while driving.
I have hands free in my X, but didn't in my VIII. It would have cost about $400 to add it to my deck in my VIII which wouldn't have happened. And taking a bluetooth headset with you everywhere you go, making sure it's charged... is just a *****.
