^ DITTO - and guess who pays for the damage? We all do via the insurance premiums we pay. I hope the insurance companies start dropping people caught texting just as they do for drunk drivers. Then the texters would have to get super high rate insurance for high risk drivers. Or, drive with no insurance and lose their car & license next time they crash. Hopefully nobody gets killed in the process.

+1 ...i agree that you shouldn't be texting while driving! thats jus stupid!...but this law is a joke...if you have tinted windows how is the cop going to tell for a complete fact that you are talking or texting on your phone? "no officer i was not on the phone i was just scratching my ear" not like cell phones are huge bricks like they were back in the day either haha

are you guys all serious that you have never texted while driving? How about reading a text? That is still part of texting.

What if I can text without looking at my phone cause I know how a QWERTY keyboard is laid out? I won't play innocent. I will sometimes text while driving, but I usually wait for a light, or stop in traffic. I also speed!

If I'm on the phone, I move over to the far right lane as I tend to slow down to 55 cruising. Texting, I could do it all the time on my old phone, but my iphone takes too much of my attention away from driving, so I gave up on even trying that unless I pull over and stop.

^agreed on soft-keyboards. they suck for texting while driving. I tend to get in the slowest lane when on the phone too.

I text while driving some times, but I try to avoid it as much as possible. As for the talking, I have wireless bluetooth in my Mazda, and I DD it so it isn't a problem.

And trying to hide behind tinted windows is just going to make having tined windows harder. If a cop pulls you over, and you deny that you were on the phone and tell him that he couldn't tell because of your tint, hes going to give you a ticket for having illegal tint.

^ this is true...but i wasnt saying to tell the cop that he couldnt see you just because of your tinted windows ...even if you dont have tinted windows unless the cop is pin point staring at you from a relatively close range (like the lane next to you or right behind you) then he's not going to be able to tell if your actually on the phone or jus scratching your ear haha...and if a cop is staring point blank at you while your driving and talking on the phone and you dont notice him before hes close enough then you deserve the ticket and need to be more aware of your surroundings

its just like a cop pulling you over for speeding when he didnt have you on radar and wasn't pacing you...he can still give you a ticket but then you take it to court and argue that there is lack of proof...or like these red light camera tickets in lynnwood...they have to have a clear picture of your face and your plate during the red light...if they dont have that then its easily arguable in court...so do what i do when i drive through lynnwood and drive with a mask on! jkjk

Even with tinted windows, at night your phone display lights up like a christmas tree inside the car. Not too hard to spot from the outside.

Bottom Line

Guys the bottom line is just put down the phone when you drive.

If a copper thinks your on a phone theyll write you for it. Maybe you win maybe you lose, but you have to take the time (and maybe money for fine/attorney) to fight it.

You will also start building your driving abstract which wont help you in future court dates.
