Hey guys I am the person that was involved in the sale. I lost the check. My mistake. I was extremely patient with the sale. I waited a month till he sent me the check. He kept telling me he will send it and I was patient. I did recieve the check and I lost it. What am I to do. I am certainly not going to send the product to him if I have not recieved any money. It is not my problem that his bank has bad policies and will not stop the check. I have not cashed it so I have done nothing wrong. I dont have his money but he still wants me to send the screens. How fair is that for me.... People shouldnt make judgments unless they hear both sides of the story.

no front to you personally but teknotikal, YOU received it and YOU lost it...isnt it kinda evident who's fault is it? i would say search harder to find that check because you already admitted you received and lost it.

It IS your problem that you lost the check, and if anything you should be 100% responsible for any fees/charges that occur to get this fixed (stopped/reissued). Yes, you need to be paid for the product, but once the check is in your hand, it's pretty much your responsibility. I'm sure the poster doesn't expect to get the product without paying, but he shouldn't be required to pay extra for your mistake, and I think you should be busting ***** to get this taken care of. It's just plain good business...

That's some good advice or whatever u call it. U are now responsible, and i would look like hell for that check if i were u.

Cashier check = cash. If you lose it, YOU ARE RESPONSIBLE! especially when you told him you recieved it. He cant cancel the cashier check, no bank will do that. It takes 6 months before one will expire. That is normal policy for every bank. If it was a personal check it would of been easy. Send the item and wait until the check expires and then he can send you another one.

Seriously that cashiers check was essentially cash. If he had actually sent you cash and you lost it would you ask for another payment? Thats why you never send cash, or money order. Your just asking to get screwed. I think it would be fair if he paid you half the original payment. Buyer has to pay more then he should have, and seller gets paid less than he should have. Both of you should take responsibility for your negligence. Just my .02 cents.

IF you received it and lost it, why offer to shred it and send back the pieces? Wouldn't that imply that you still have it?

I think they buyer was negligent in sending a cashiers check. Obviously the seller isn't going to send the goods without getting paid. At least in my situation both people take responsiblity instead of the buyer just getting screwed.

Yes I am absolutly not looking to get free product here and I do take full responsibility on not gettin ghim payment fast enough but the fact that the check was lost and now I am basically out $140 for at least 6 months and the seller won't ship me the screens as well, I am really just getting shafted with no lube. I would have no problem putting a contract in place stating that in 6 months I will pay once I can cancel the check, hell I could have something drafted up by our corporate lawyer and I would sign and noterize the document and if I backed out on the deal he could technically sue me for violation of contract. I am just frustrated that this happened I thought I could trust Hikmat because of his seller rating but I guess not. And to comment on the post about paying $70 again to the seller and in 6 months paying the additional $70, how can I trust that he won't loose that check then I would be out $210, I feel that the only fair resolution would be him sending me the product since he admits fault and admits that he received the Cashiers Check (Essentially Cash).
