got a speeding ticket and i wasnt speeding - south florida

Ok. So i couldn't sleep and decided to go for a cruise around. I decided to drive around here, fort lauderdale, to explore. I was cruising at about 51mph when i saw the cop. He was between two trees off the side of the road. I then breaked down to around 40mph because I wasn't sure if the limit was 45 or 35. We made eye contact when i passed him farther down the road and i knew he saw me brake. He then pulled me over.\

I ask him, if there's was problem. He answered me with something like, "you are pulled over". I tell him i don't know what the problem is, i wasn't speeding. He then said he clocked me going 61, my radar did not go off at any point. He then says u must have broke after i clocked you and when my radar went off. ****. Im def bringing this to court

What a freaking waste of time. Im going to turn in this not guilty plea. Anyone know if i can deal with this ticket any faster than waiting for my court date? Maybe by talking with the DA prior? I just wanna get this over with asap.

Any advice for my court date is greatly appreciated. thanks.

i asked him if i could see the speed he clocked me at on his radar. He then said that his radar clears the speed after it's clocked, which doesn't along with what i've heard about radars.

I told him i broke down to 40 after i saw him. and he said, "how could u see me in the dark when i was hidden behind a tree"

ah, so it was a speed trap.. which is illegal, at least in CA it is. Also he needs to show you the radar gun. fight it, it will geet thrown out for a fact

From experience, most people fold in court if the cop shows up.

BTW: traffic court is a money making scheme. The judge WILL be bias, because the cop's word is heeded more in favor. If you spout, "he's lying." The judge will hear no of it.

keep postponing/changing your court date....and mostly when you show up..the cop won't be there and they'll drop the charge. That kinda crap happens here with the dam'n bike cops near the University....

They usually have pre-court and you can present your case. Unless you have an older detector, you would've had an alert, unles he used Laser which should be marked on your ticket. NEVER just pay your ticket, that's the worst thing you could do. Don't use driving school unless you really need it, as you can only use it 5 times in your lifetime, save it for the bad ones(which hopefully will never happen!).

Traffic court can't retry you if the cop doesn't show up. Automatic dismissal.

The officer doesn't have to show you the gun. That is a myth. Get a lawyer if you want to get out of the ticket.

+1 for the lawyer! I didn't even have to show for the last ticket, case dismissed w/ no fees, nothing! I have Pre-paid legal, they handle any ticket I get for $26 a month, they just recently got my sons ticket dismissed w/ court cost, and he's 17, so thats huge!

Hmm... I don't want to comment on the legality of it, except that, getting a lawyer is probably the way to go, I have not done it myself. But I think many lawyers will give you a free consultation if you call and ask for one, or keep calling around until you find one that does. Then, of couse ask about his costs, etc.

As far as getting pulled over(this isn't aimed directly at you), don't play dumb, roll down all your windows, stop in a well lighted area, have all your paper ready, and depending on where you live, keep your hands in plain sight. etc. Everyone knows what happens when you get pulled over, whether you're in the wrong or not.

First I like to say that your attitude goes a long way. Be respectful and don't tell him how to do his job and you'll be fine. Sometimes cops do get a hard on on the power but alot of times people become smart ***'s and get every ticket they deserve. If I was you get a lawyer to handel it. Don't go into the court room and say he's lying. The Judge will be like who's this punk. Tell the lawyer that you wasn't speeding and to verify the speed gun. I pretty sure it logs your speed every time. If you got a ticket for speeding it's probaly cause you broke hard when you saw him, and if you was already going the speed limit why would you break. I did this once but to get out of going to jail and get the ticket for going 88 instead of 115mph. They know your speeding when you front drops. Your only effort now should be to swallow your pride and hire a lawyer. He'll do the rest and you won't even have to show up to court. Plus another thing don't reschedule the court dates cause he will always show, cause he has too if not he's held in contempt. Plus he gets paid 3 hours overtime anyways. Why I know all this cause I'm a cop and my buddy works for FT.Lauderdale. I hope this helps you
