Unhappy Exhaust Ticket

Hey everyone,

Long time EVO driver and car enthusiast... had modified exhausts for the past 10 years.

This year I have made a new friend in the form of a FHP officer who has now given me 2 tickets for a modified exhaust under state statute 316.293(5)(a).

He saw me today and gave me my second.

Are you all having this issue? I have never, ever, had an office even pull me over much less give me a ticket for a modified exhaust in all these years. I drive carefully, at the speed limit, don't have speeding tickets (last one was from I believe 2003) and believe me I didn't give this guy a reason.

He ended our meeting today by saying "no matter what a judge says, if it's in the books I'll keep giving you tickets". Harassment much?

Need some feedback folks. I know most of us have exhausts on here so I wanted to know what you all have experienced with this.

Yes I have been pulled over in my ix for "loud exhaust".... twice. I had a helix down pipe, helix v2 test pipe and greddy evo 2... It wasnt that loud.... But they didnt write me a ticket either time for cuz I played dumb and said I bought it this way and didnt modify it... So he gave me a tint ticket instead....

when i first got my car i got pulled over for my exhaust too. only problem was it was the STOCK one

I have been pulled over by state popo, for other reasons. But he went threw my entire car pointing out all the illegal mods. Everything from ride hieght to window tint. Then he went as far as getting on his hands and knee to look under my car to see if I had a cat on my exhaust. But any way he said that the law states that you can not modify from stock. When I atleast knew that the law is it cant be over a certain amount of decibles.

In this state the statute states that it cannot be modified from stock, only problem is that some dealers now put catbacks and axlebacks (depends on what car) exhaust. So technically its stock! Now I would file a complain on that officer for his comment, that should get him off ur case. There are a few different statutes on exhaust. it all pertains to different vehicles and situation. Now most of the time cops will use it for PC (probable cause) to pull u over. Its all based on the cops discretion. As for FHP we call them AAA for the state since all they do is traffic and babysit people with blown tires, so he had nothing better to do. Also he can keep giving you tickets so that's why I say complain to get him off your case. Source comes from my 2009 Florida State Statutes book and experience. Hope my info helped

LOL^^^ on that last comment.AAA. ftw. also to the other guy. i tried that whole it came witht the car trick too it never works for me. ive been pulled over lots of times for BS tickets. its like they are bored out of there mind and untill they see your car. most cops dont even know what an evo is. lol. and some have admitted that my exhuast sounds great but they had to site me. probably to make their quota, so they dont get laid off. i usually just put a silencer on my muffler and get the ticket signed off by another officer.

Well if it's a "legal" exhaust you can try contacting SEMA for advice. I have heard they have provided free legal assistance to people, but never experienced it myself.

"(4) APPLICABILITY.--This section applies to the total noise from a vehicle and shall not be construed as limiting or precluding the enforcement of any other provisions of this chapter relating to motor vehicle mufflers for noise control.

(5) NOISE ABATEMENT EQUIPMENT MODIFICATIONS.--

(a) No person shall modify the exhaust system of a motor vehicle or any other noise-abatement device of a motor vehicle operated or to be operated upon the highways of this state in such a manner that the noise emitted by the motor vehicle is above that emitted by the vehicle as originally manufactured.

(b) No person shall operate a motor vehicle upon the highways of the state with an exhaust system or noise-abatement device so modified. "

"(c) For motor-driven cycles and any other motor vehicle not included in paragraph (a) or paragraph (b): Sound level limit
Speed limit
35 mph or less Speed limit
over 35 mph
Before January 1, 1979 76 dB A 82 dB A
On or after January 1, 1979 72 dB A 79 dB A "

"(2) OPERATING NOISE LIMITS.--No person shall operate or be permitted to operate a vehicle at any time or under any condition of roadway grade, load, acceleration, or deceleration in such a manner as to generate a sound level in excess of the following limit for the category of motor vehicle and applicable speed limit at a distance of 50 feet from the center of the lane of travel under measurement procedures established under subsection (3). "

Well per FL law, no exhaust other than factory would be legal basically. That's basically 98% of everyone with an exhaust.

I was thinking cat-less, but either way. Did you try SEMA?

No one i know has this problem in orlando, but in daytona they will cite you if they hear anything that isnt stock...ironic eh?

just get a receipt saying it was replaced and go to court. if it works the same way there as it does here, all it is an equipment violation. if you have a receipt showing it was replaced, it should be fine

Cops don't even look at my car. I've always stuck with quieter exhausts though to keep from being noticed.
