Violation of Vehicle Code 4000.1 B (pollution control device)

I just got a ticket in the mail....and i couldn't figure out WTF it was for. I finally found the Vehicle code online.. and it was for some pollution crap. I only have a works axle back and downpipe...Would that create illegal pollution? heh... im trying to figure this out.

The vehicle code was 40001B on the sheet.. so im assuming thats 4000.1 (B) there is also a 4000 (A) ... if anyone knows anything about this.. that would be helpfull..

I swear that we are freaks in this country. Everything is considered air pollution... other people around the world enjoying their cars and we are sucking on crap here. DP will never cause extra pollution. I understand that its a good thing to keep bad cars off the streets but our cars and new cars in general are clean. I don’t know why they don’t chase behind the SUVs and big manufacture and only give us crap .

in reply to your question, i just recieved the ticket today in the mail. I never got pulled over... and never saw a cop near me. The paper said i was ticketed on the 19th by an officer. since when did they not have to pull you over? WTF? (this was in marin county)

Welcome to the club. At least they used a different provision against you ... I got a 27156(b) Gross Poluter violation for a GFB blow off valve (since when does putting a higher quality VALVE in the INTAKE system change emissions).

Basically CA law is f*ed up ... anything that doesn't get certified by the manufacturer for legal use in CA (a process that is very time consuming and I've heard runs around $10000 per part) is a violation regardless of whether or not it effects emissions at all. Or at least that's how the police and state referee both explained it to me.

So anything as mundane as the Samco replacement turbo hoses are probably a violation.

Oh, and even better, when I tried to reason with the Stanford cops that such a law (arbritrary ticket that forces your car off the road) is both an unreasonable burden (I got ticketed on thanksgiving, and our campus closes down = no food for me if I can't drive my car, etc.) and that ticketing me for a GFB that was functionally identical isn't in line with the original spirit of the law I practically got laughed at (by which I mean yelled at).

so... even if my parts were installed at a mitsubishi dealership its illegal?... how are they allowed to sell that? seriously, theres something wrong with that.
How did the "officer" that didn't even pull me over, know what i had in my car anyway. I never parked in a public place the whole day in which they said i was issued the ticket. And i never saw a cop that whole day. I just dont get it.

How in the hell you get a ticket for your dp and exhaust if you never got pulled over?

Wow that whole thing is crazy! Next they'll start arresting you on the spot with no phone call and no bail for having a TIP on your exhaust! And all those cops sit in a rich running v8 with the heat or AC on FULL and all the windows down! Insanity!!

YEA...thats what i want to know. Im definately calling a lawyer about this. i hate godamn cops. There was a cop that was tailgating me for about 15 minutes 2 nights ago. But that wasn't the date which they said i got the ticket. I shoulda slammed my breaks on, since im sure my evo can stop better then his pig car and just say there was a cat in the road.

Yeah ... welcome to the world of American Law.

It's a direct result of capitalism + administrative law which basically shafts due process and doesn't allow you to make traditional claims like since the part is essentially the same as stock, only better made, you should be able to use it.

CA law states that any part in the intake / engine internals / exhaust without an Executive Order specifically allowing it is illegal.

Of course I am not a lawyer ... but like myself I advise you to contact one for their opinion.

4000.1 (B) VC is a registration violation, did your car not get smogged, or did you not pay fees? Is it not registered? What exactly does your ticket say in the violation section?


Here is what I found online reference the code sections for 4000 VC:

It would make more sense, because you can get registration tickets in the mail, you don't have to be pulled over.

No, welcome to California! Only another example of how wacked out things are on the left coast and a perfect example of the reason I moved to Texas from the Bay Area.

There are only a few states in the Union where this sort of wackyness happens and California seems to be the worst.

But I sure do miss the winter and trips to Tahoe and summers without heat!

You guys think it's bad now,wait a year or 2 for OBD III and then the *hit will hit the fan.You will drive down the freeway and if your check engine light comes on they will mail you a notice to go have it checked out in a certain amount of time and if you don't they will suspend your reg.To be continued...................................OBD III,the nasty start of things to come.
