Need advice asap!!

Two days ago my car was backed up into AGAIN, by a lady... says it all right...
I got her insurance info and all that good stuff, it was her fault 100%. I take it to my local body shop to get an estimate done, damage is on the passenger side rear bumer and by the fender. Her insurance is Progressive, Progressive shows up today at the body shop to look at th bumper and says ok this bumper should be REPAIRED not replaced... my body shop says no way, those clips are busted and the bumper needs to be replaced with a new one.. I'm caught in the middle of this where the body shops wants a new bumper and progressive said they will only pay for the repair done to the bumper.

WTF do I do guys... this is the 2nd time in a MONTH someone has backed up into my brand new car.

Tell progressive your neck is starting to hurt from the accident!



Well your state probably has much different laws than my province but did you get multiple quotes?

If 3 different body shops/dealers agree on replacement Progressive will have a hard time disputing your claim .

If in doubt, call a lawyer. I'm guessing Progressive will start to play ball when they realize you're not ****ing around.

One positive note about progressive is they backup the repair job for as long as I own the car, so if something does break on it they will pay for it to be fixed again. however if that did happen i'm willing to bet they would pay for the same repair not a new bumper cover.

I would try calling your insurance company. They have a whole fleet of lawyers lying around just for this sort of occasion.

^ Exactly. If you are insured and involved in an accident that is 100% not your fault, your insurance company is one of the best resources you have. Unless, of course, your insurance company is Progressive.

Get it done right, not the way of a company wants the cheap way out..

Go get a few body shops to look at it, give them the quotes from each of them, if they still wanna dick you around then get the lawyer involved.

Half assing the repair could cause you alot of problems down the road.

What state do you live in? in oregon YOU have a right to choose any shop to do the work per that shops work order. Like some else said, call your insurance and get there team of attorneys on it. good luck.

I live in Wisconsin, I just sent an email to my lawyer. I will also contact my insurance agent who is working on the previous claim from the previous accident.. I just have the worst luck already this year.

My RA's was in two fender benders in the first 45 days of ownership... two new bumpers later. Dont feel bad you're not alone.

I got rear ended within a month of owning mine too. I don't see what people have against us. I hope this gets settled soon, best of luck.

1. In ANY state you have the right to tak eyour car too ANY repair shop due to an accident not caused by yourself.

2. Proggressive does NOT get tp pick wether the bumper is replaiced or repaired. That is up to you and your shop.

3. If they do not cooperate you can call your insurance and the better business bureau and they both of them will be on Progessive's *** so fast they will cry and buy you a new car! (lol prob not but they will bend to your will). Remember they are responsible for all damages and their ajusters are not trained proffesionals; they just have every repair book ever made which makes them think that they are. So if the proffesionals say it needs to be replaced, then it NEEDS to be replaced.

4. Please tell progressive they can suck your wennier because they are asses and always pull this crap. I know because my last car was totalled by someone with progressive. Long story short I sued the crap out of them, won, and got enough money two new cars! (They were only going to give me 10k) Laughable considering I was driving a fully loaded 09 Escalade.

Try to use one of Progressive's preferred auto shops. Usually they are at a dealership and they will probably agree with your body shop...Either way it would/should get fixed correctly.
I agree with your shop that if the clips on the bumpers cracked then any minor bump could just loosen and make the bumper not hold up....

I would call your insurance company. They will fight for you to make sure your getting what you want. In previous accidents my insurance company cut me a check and then went after the other peoples insurance company's to get their money when it was 100% their fault anyways. But my car was fixed asap and I didn't have to worry about anything.

You already pay your insurance why not use them rather than paying extra for your lawyer.

So, I have a question, what is the best thing to do if someone hit your back bumper in a parking lot (it's not that bad, just a small dent) while you were away for a week, and they didn't leave any info?
