Got backed into while driving

Got backed into while driving

Yesterday I was cautiously driving through my school parking lot looking for a spot. Next thing I know...boom, I got backed into. Girl that backs into me jumps to conclusions saying it was my fault and such. I give her my info but she refuses to give me hers. All I have is her name a number and license plate. Since my school has a private parking lot cops cant write a report.

Today I call my insurance tell them everything and give them the only info I have. No deductible and I'm taking it in to get the damages repaired soon. As for the other person, she still thinks my insurance is going to cover the damage or have me pay out of pocket? The only damage done to her mini van is a couple scratches and a crack.

Well I don't know U.S. insurance, but in Canada IMO that would be 100 percent her fault if she backed in to you. I don't see why your insurance would have to cover her damages, it should be her own insurance covering them because of the fault. Sorry to hear either way. On another note though, you can wait up to 1 or 2 years to have the work done. I had someone hit me in a parking lot, 0 deudctable, they scratched my RR fender/side. I ended up waiting a while and I acquired a few more dents and dings on that side. When I took it in to get it fixed they obvisouly re-painted the whole panel, so it looked good as new.

Thank you, well in Michigan its no-fault so its 50/50. Haha I cant be driving around with this damage people stare at it. I'm getting it fixed asap.

Even though it is on private property the police can still do a courtesy report. I used to be in law enforcement and had to take private reports a few times because the property owner or people involved requested them. In Kansas we are a no fault state as well but your insurance should still investigate. You can't drive your car side ways so its obvious someone did the damage backing into you.

I hope you get things worked out.

i dont know how it can be your fault unless you drifted through the carpark and slide into her, because your car cant go sideways and run into her

Why wouldn't she be at fault? Dont you have you yield when leaving/ moving from a parking space?

Damn, which school are you at? Don't have to answer if you're not comfortable making the info public of course. Sorry to hear.

I think the no fault 50/50 rule is different when damages are incurred in a parking lot, but I could (probably am) wrong. I would double check with your insurance to be sure. Do you go through an agent, or directly through the insurance company? Situations like this is where an insurance agent would be extremely beneficial .

Vehicles driving through the parking lot have the right of way over those pulling out of spots. It's pretty simple to see that the damages start at the fender so she would have to be a complete idiot not to see you. That's why I always back into spots. Also why did she refuse to give her insurance information? How suspect is that?

Thats what I'm suspecting. I asked to hand it over 3-4 times and she never got around to doing that. So I left and took my test.

Totally her fault if she was in reverse. I think you should raise bloody hell with your insurance company. The companies are basically in cahoots with each other, but you can make yours work for you. Don't believe the first thing they say. If they wont work for you make sure to change to another company just to prove a point (even if they don't care).

ya, i have never heard of that before, i mean laws vary from state to state, but if it happens def. always just call the police, cuz who knows what could of happened, they coulda arrested the dumb ***** for no insurance or who knows anymore, i mean i am a dispatcher for my local sheriffs office, and we take these calls all the time, we get someone backed into my vehicle all the time. If someone strikes your vehicle they are at fault almost 90% of the time, if they are in reverse the same rule applies, they dont get any more freedom or leadway just because they are drivin in reverse. I mean in all honesty "private property" is all property, royal farms, shell, walmart, colleges, your house, anything other then a roadway(not including driveways) is private property. Im not sure of the law there in michigan however the cop would have atleast made sure that you got the info you needed and made sure you were all valid drivers and had the proper paperwork and insurance. Good luck in your insurance endeavors lol your gonna need em to get anything done with insurance companies
