I need help + advice, 30 miles after dealership work = internal engine damage...
here is a little known legal fact. get a tow truck to get your car now and take it to another dealer or reputable mechanic. DONT PAY THEM A DIME WHEN YOU RETRIEVE YOUR CAR. most would assume you have to pay the bill to retrieve your car. this is not true. I had someone do this to me. they came to pick up car from me but refused to pay the bill. cops were called to the scene. cops informed me I had no right to hold car. it was his property and I cant refuse to give it to him. I was shocked. my legal recourse was to take him to court or file lien against car for unpaid bill. turn the tables on them. you never gave them the okay to tear into the car and they are ripping you off plain and simple. make them take you to court. they screwed up and are not owning up to it.
My gvr4 that I lemon lawed had this same procedure done except I had it retrieved from a used car shop to Mitsubishi

Well at the moment my car is in pieces, so kinda tough to get it towed out of there. I would rather it be worked on at Baierl Mitsubishi, but the Evo guy is booked until the 1st of 2013... Mitsubishi America said that a further tear down to examine the full extent of the damage is required to open up my claim case. I'm between a rock and a hard place, so I gave them permission to take the car apart further.
Meanwhile before I gave them said permission when I called this morning, the service manager told me that the tech (without my permission) took off the valve cover and took a spark plug out to look inside the engine. The tech saw some timing valves broken off. Apparently this dealership can just go in and do whatever they want to your car, say one thing and do another...

I honestly didn't know what to do. I know what you are saying though, but I needed the further tear down to get this claim made so I can progress from there. I have been documenting everything and keeping the claim log updated with the little things that are going on. I am hoping once the, "At fault" is established that I can get it put back together as is and get it towed to another dealership for the repair. I'm trying.
You do realize that by allowing them to continue on with the work allows them to cover up their mistakes even more and blame it on your light modifications.

-Is it possible for oil to cause the timing belt to skip a few teeth if it is properly installed / tensioned?
-Is it possible for the oil pump seal to back out with whatever internal pressure is placed upon it?
-What should I do from here on out? They are saying that it isn't their fault. My buddy said to open a case using the Mitsubishi America number and go from there.

I say you go down there right now with a tow truck and retrieve the car. Bring a plastic tub and put all the pieces that belong to your car in it, And bring it somewhere else. Your better off with any other place taking it from here, then to let them keep looking. Think about it, they are not looking for a way to help you get covered, they are looking for the problem so they can blame it on anything but themselves. There is 0 chance that they are gonna come back to you like " hey guess what, our tech effed up and blew your motor, dont worry were gonnna cover the damages and give u a loaner" ..... 0 chance bro
Wow this is a tough situation to say the least. This is why I don't want to take my car to a dealership here in Canada for a timing belt. Although I don't feel I want to do it myself lol I have done the clutch, but knowing my luck I would mess up the timing and wreck my engine.
Booked till the 1st of 2013? Thats like 3 weeks, which is sooner than anything the current dealership is going to get done.
If it has broken valves (not uncommon with a skipped belt) then the head has to come off and go to a machine shop. It will need valves if its not totalled, the pistons need looked at, cylinder walls, etc.
Load it up and have it dropped off at the other dealership or at least a different shop. It will be worth waiting for vs getting screwed anyway and screwed at dealership hourly rates.

A Mitsubishi Motors of North America case manager called me today. Pretty much what he said is that South Park Mitsubishi is denying blame and it isn't MMNA's responsibility to do anything else since my car is out of warranty (2003) and the dealership is privately owned (as most are).
So that was a "Thanks for nothing, but wasting my time", type of thing. Next move for me is to find a lawyer and talk to him about my situation. I guess that I need to find an attorney general lawyer for this type of incident (Pittsburgh area)?
As far as the dealership goes, they haven't updated me on removing the head and any new findings with that.
