They brought the tech in who worked on my car, the owner, and a lawyer. I was by myself. Since I'm not a mechanic I couldn't speak against what their tech said (even though it was bull****), the judge only allowed me to repeat what the other mechanics who looked at my car told me and anything else he kind of didn't pay attention to in depth. I had two written statements, but their lawyer wanted them dismissed because the mechanics themselves weren't present. He ruled not in my favor, but told me I can appeal and take it down to the city court in front of a panel of 3 judges and have the mechanics subpeonaed if need be, but I'm sure they would be some what willing to appear. If that hearing is also not favorable, I can appeal again for it to be presented in front of a jury.

Their tech told the judge that the balance shaft locked due to the car leaking out too much oil (he told me 2 quarts of oil leaked out, in person on the day that he took my car apart) because the oil pump gear seal blew out. Meanwhile when he tried to remove the seal by hand he couldn't he then used the oil pump gear to try and stab it out in front of the judge. I had to hold back my laughter of how ridiculous this was and how he suggested that it just blew out on it's own. The judge asked a cop who is a "Kind of a side mechanic", to hear out the story and he sided with tech since he was under oath. Then he commented on that if there was a leak that he couldn't have seen it anyway cause the pulley was covering it. (Even though that gravity would cause oil to leak downwards and that he would notice it regardless of what was covering the area.)

Anyway all of what he said was crap, but I thought I would let you in on a little bit of what went down. Next update might not be for a little while, but I have to get a lawyer involved and appeal, then go from there.


BTW, I had my car fixed at Buschur and they did a great job. I was surprised how fast they got it together once all the pieces were at the location. It has been running great, now I just need to handle things on the legal end and hopefully bring a happy ending to this nightmare that I am having. I saw that their lawyer had the Buschur website printed out and I'm guessing he also printed out performance parts from there. I'm sure if the tech's testimony didn't go as planned that he was going to pull the "Performance racing shop" schpeel. I really wanted to hear that one, lol.

This is a crazy world we live in. If the damn mechanic ****ed it up, than why not man up and fix it. I was a mechanic for 5 years and this was one of the reasons why I stepped away from this kind of work, not because I was messing up all the time but the actual customer confrontation if something went wrong. Nowadays I prefer to work on my own and thats about it.

I was with you all the way from the beginning and all I can say is sorry it ended this way

Small claims court. Most Mitsubishi dealerships cant work on evos, remember it.

I talked to a lawyer and a law school graduate. They said that I could represent myself in small claims court. I would rather have my hearing at the city court though and for that I will be getting a lawyer. Not saying that the local judge favored the dealership, but they are within a few miles of each other and have that whole "Been providing outstanding service to the local citizens for years" thing that they spit out.

I can see your point man and I wouldn't want that on me either on a day to day basis. Especially after I hear stories of mechanics going into work after a night of boozing lol. It is not over yet though, two more chances for justice to prevail.

Update: My case is going through the appeal process now and I'm just waiting for my day in the city court, it is taking a while though. I'll let you guys know how it turns out.

Any update? It sounds like he put two much tension on the timing belt tensioner which "pulls" up so much on the sprocket that it puts too much on the shaft n housing and since the gear is steel and housing is aluminum (which acts as a bearing housing since the shaft has an oil hole in the middle of it and has a smooth surface on each side for it to ride on pressurized oil) so the excessive tension didnt let the oil get in on both sides of the shaft which eventually digs into the housing and causes play n will ruin a seal and let it leak because the excessive play. Does the housing look chewed up? Or the shaft galled up where it rides inside the housing? If so Im sure thats what happened, ill post a pic of what the shaft looks like so you know what i mean with riding on oil in the housing....mine was too tight and started to dig into the housing and the shaft. Do a search and youll find a thread where someone set it so tight it oblonged the oil pump housing, in case that might help anyways.

ouch. That really sucks. You definitely should have gotten a lawyer to represent you and help you in this case.. Fwiw, The legal system nowadays isn't about whos right or wrong, its about who has the better attorney... Ask OJ.
