warranty problem

warranty problem

you can see my mods on my sig.
well, the car has been having loud whining noise so i went to the dealership and have them check it out. they said the rear differential is the problem. ofcourse i asked em if that will be covered under warranty- ofcourse they said no. the service manager even gave me a long lecture about how the engineers developed the whole car for years etc... which BTW i didnt need to hear...they wanted to charge me 700 bucks to take the differential apart and then diagnose the problem and give me a price quote for the parts i will need. i declined and told them i will think about it.
i talked to one of their techs, and he told me that i can take them to small claims court and sue them for denying my warranty. they have to prove that my mods caused the damage to my rear diff. if it was the clutch or the engine that got messed up he said then they might be right. i dont know , maybe its worth a try.
what do you guys think?

its worth a shot. u might want to ask the dealership which mods specifically voided the warranty, then use that against them by finding if that particular mod would cause the rear differential to go bad. Otherwise they will keep changing their mind of what mods affected it without no basis.

personally i think going to the dealer with that list of mods you should have known what was
going to happen. i dont think you will win because of the extra power you put in the car they will say that is what ruined the differental.

yeah i know, i have to pay to play... the new diff could have been my new clutch! damn it!!! i am depressed....
i wonder who sells or rebuilds rear diffs for cheap.

actually if you read the warrenty included with the car (that you signed) you are required to go through their arbitration process prior to filing a civil lawsuit.

good luck, you'll need it. (and I agree they shouldn't cover it, with an upgraded turbo and boost controler it is your dime)

so go through the arbitration. you'll definitely lose, but then take it to court. courts ruling is what counts.

just talked to RRE. they say its the TC and not the rear diff.

I never signed the arbitration form. My dealer wanted me to, but I told them no. The sales guy went to go talk to his boss about it and came back and said it was OK if I never signed it since I was paying cash for the car. IDK if that makes sense but thats what his reason was.

I refused to sign it more on the grounds that if anything ever broke and caused me injury, I didnt want some arbitration BS determining any outcomes. I think I made a good choice not signing that crap.

As far as your warranty goes, youre pretty screwed if you take them to arbitration. All they have to say is that the increased power went beyond the design limits of the car. Mitsu will argue that the power caused accelerated wear on the parts causing failure (which it did). With those mods, you really don't have a chance.

The ONLY way I think you might have a chance is that you bring in an expert witness engineer (i.e. passed the professional engineering exams) who has intimite knowledge of the design of the car....basically...a mitsu engineer...and have him testify that the parts could not have caused the failure. Then you might have a chance. And in reality, I doubt they would testify against their own company even if on the off chance you knew one. Better start saving up for a new TC.
