Diminsished value is what term most use. I had a 350Z, got hit (had 30 day tags on). Damage was around $4,000. Was able to get $1700 in diminished value as a straight check on top of repairs being paid and completed. Some states do not recognize diminished value (in their code), but do a search for diminished value and you will find most of what you need. My definition, diminished value would be the value lost (if you sold or traded) because the car is no longer in it's "original" state. Thus, the accident has diminished its value compared to an accident free one.

 

Diminished value would apply regardless of who was at fault if applicable in your state (if my memory is correct).
