Gonna visit State ref..please help

Okay so I get pulled over today for not having a front license plate and the cop tells me to pop the hood...oppsy...looky looky here MODIFICATIONS! So he told me I have to go to the State ref!!! Need help to pass. Look at my signature on what I have and tell me what I need to pass. All sugestions appreciative!!!

Lose the intake and make sure you have a cam gear cover, it should look stock then. If the downpipe is seen, say you ran over something and its a cheap ebay replacement.

Thanks for the responses. What about the flash? And I saw something here about the turbo timer...that it won't pass if it had one

The flash cannot be seen so it's ok. You need to pass smog and sound test (95db I think). Yeah! Take off your timers, put back stock intake and you should be ok.

My main concern is the HKS cams and cam gears...I have the 272/272 so it's lumpy. I don't want to take them out.

i live in nor cali too, if your by any slim chance going to the state ref on florin, hes like an older guy and he was cool, when i got pulled over in my DSM 6 months ago, tested my sound it came up to like 98 bp but he signed me off anyways, i had piping on my DSM he popped the hood took a look and said ok your good. so go to the state ref on florin road if you can.
hopefully that guy still works there and you should be fine even with your hard piping left on.

I think the flash will effect it depending on the tune. If you can flash it to make everything VERY conservative, you may have a chance. Can anyone varify whether cams and flash emit more or less pollutants? There is a window but the question is are you within that?

Some may consider me from the "dark side" per se.....

You got a ticket for no front plate so why did the cop ask you to pop your hood? He has to have a reason for believing that your car had illegal parts on it. If he saw you had an aftermarket exhaust, that in and of itself is not enough for him to make you pop your hood. If he saw that you had an aftermarket exhaust ("aftermarket" meaning non factory, BUT non factory can still be LEGAL) and your exhaust is LOUD, then yes, he can make you pop your hood to see if you have no cat or other illegal parts. YES, he can make you rev your exhaust. YES, it is a subject test from the cop if he believes it to be too loud (he does not need a dB tester in-hand right then)--then you go to a ref and get it objectively tested by a dB tester.

So why are you going to see a ref? For what exactly are you getting your car tested?

If the cop said, "I pulled you over for no front plate," and made NO mention about, "and your loud exhaust," AND your car was off when he walked up on you, AND he did not tell you to (to turn your car on) and rev the engine, THEN he had no reason to make you pop your hood. Therefore you can fight having to go to a ref. Do you understand?

The cop can say, "I pulled you over for no front plate and I see you have an aftermarket/modified exhaust (which in and of itself is STILL LEGAL), please start up your car and rev the engine. I would like to hear your exhaust." Well, then you are ****ed.......If he made no mention of your exhaust and did not tell you to rev the engine, then he had NO reason to make you pop your hood. Understand? There has to be a connection between finding something illegal and making you pop your hood. "I see you have a broken tail light, please pop your hood," is not a legal reason to make you pop your hood. "I see you have an aftermarket/modified exhaust," IS NOT A LEGAL REASON TO MAKE YOU POP YOUR HOOD!!! A new muffler from Midas is, by definition, a modified/aftermarket (non factory) exhaust. "I see you have an aftermarket/modified exhaust and it is loud," then the cop can make you pop your hood.

Go to court and pay for the ticket, but tell the judge that you are contesting having to go to a ref for the reasons above.

NOW EVERYONE LISTEN.....don't give attitude to any cop (yes, there are some stupid, rude cops) or he will do his best to write you up for ANYTHING AND EVERYTHING.

YES, a cop can impound/tow your car right then and there on the steet if he thinks your car is violating smog laws. Give a cop attitude and you can lose your car on the spot!

The advice I have given is FOR CALIFORNIA LAW ONLY!!!

Is it worth not passing and paying a fine? Take them out and be done with it. Go back to the stock cams for the time being. AEM intake has to go, Authority D/P has to go, RS-R CBE has to go and the TT has to go as well. Put all stock parts on, go to the ref and pass with flying colors, simply as that. After that, if you feel the need too, put back aftermarket parts.

Stick, have a qustion for you.

I received a loud exhaust violation couple weeks ago and went to the state ref to get it tested. It came out to be 91.7 dB which is within the law limit. When I went to the court to get the ticket cleared today they charged $10 compliance fee.

Now why do I need to pay money for a perfectly legal exhaust. I didn't argue because I was in a hurry to go back to work but in the future what do I need to do so that I don't have to pay any $$$.

I guess what makes me mad is that Cops in Cali can give you a loud exhaust ticket just because they "Feel" the exhaust is too loud and it just makes no sense to me that because of what they "feel" i have to pay the fine.

I know it sucks to pay the "compliance or processing fee" but I would just deal with that. I had to pay $55 for a "no front plate" ticket. I put my plate "on" and had a friend sign it off. In the end I still only paid the $10 processing fee.

Cops in Cali are pretty bad, but that depends mostly on area. I have heared Freemont, Irvine, San Diego, and other small PDs are really "bad"--seem to ticket for everything.

The dB is subjective. If the cop thinks it's too loud, then he can ticket you. Only the ref has to use a dB tester to make it officially "loud." It's kind of like this: a cop does not need a lawyer and a judge present to make an arrest legal, he only needs to come to the conclusion that a crime has been committed. If he believes a violation has been made (of the vehicle code or whatever), then he can ticket you. You or the court will prove otherwise.

I am pretty sure the aem intake is c.a.r.b exzempt.

You should put your stock dp on, turn up your idle so your car wont have the lumpy idle.
Make sure your cam gears are covered up by the factory cam cover.
Your turbo timer should be fine... I dont see why not?

And lets just hope you have a good tune thats not too rich... The stock converters will help burn the raw fuel but if your tune is on the rich side it still may not pass.

Your best luck is to be upfront and honest when and if they ask questions. Dont play dumb... they get guys that play dumb everday and those are the type of people that get fines...

Honesty will prevail....
