This is 100% correct. The tow truck driver is the professional that is supposed to know the correct procedure for towing.

EDIT: Here is a thought ... take the car to the dealer and if the diff is screwed, you can probably get a written statement that the damage was very likely caused by an improper tow. After that, the towing company would have to provide records that they did tow the car correctly. Since they didn't, they will not be able to show such and the case is pretty much yours.

You need a new center diff. no questions. Get a lawyer cause this is gonna cost big bucks.

ive seen a few of these threads with no results....like stated above, it doesnt matter why you were pulled over or why they towed it. they broke it, and nothing gives them the "right" to do so. if you cant miss anymore work, work that into the lawsuit. make them pay for time missed. yeah you might have to wait for that money but to replace the diff and whatever else might be damaged on their $$ and not yours im sure is worth it

transfer case is done. on ebay for $3.99 you can get a little yellow sticker to put on the dash by your VIN that states an AWD vehicle, flatbed only, tow company will be held liable for any drivetrain damage as a result. then they really have no excuse since they had to have seen the bright yellow sticker since they have to record the VIN prior to tow. just a little insurance for the rest of us, i know this doesn't help the OP any. i'm sure there are some tow driver's out there that don't know what an evo is or that it's AWD.

Well for sure I'm going to take it to the dealer to have it checked up now. I hope that there's nothing wrong with the center diff.

All 3 lights on is an error code from the ACD computer. There's 100% *something* wrong, but the severity is the real question.

Here is some good info for you from my Dad (who owns a towing company).

Call the towing company and find out who their liability insurance company is. File a claim directly with the insurance company. If they ask why you need the info, just tell them that your car was damaged and you are going to file a claim.

The big thing you have going for you is that they had the keys to the car and could have easily avoided damage. It's not like the car was abandoned and needed to be moved due to it's location. The could have driven the car to the impound and avoided damage.

Some insurance companies do not cover tranny damage apparently. My Dad had to pay out of pocket for a damaged transmission recently since it was not covered.

Feel free to PM me if you'd like and I can try to get some more info. Like I said, my Dad had been on the other end of similar situations. Even decent, reputable towing companies have issues sometimes.

You can actually tow an awd vehicle without a flatbed but they must put dollys under the other 2 wheels. If they didnt do then sue them.

sorry to hear about your car i would definatlly get a lawyer.

but i have no pitty for you breaking the law and driving on a suspended license. but again i would of refused to let them tow my car without a flat bed.

I had the exact issue happen to me. Gladly I did open a claim and within 2 weeks I got a nice fat check to cover a new transfer case and scratches to my bumper. The best news is that I managed to get a used transfer case for 1/3 the cost. with only 8,000 miles. And i pocketed the rest which i used to pay for the ticket and now it's time for upgrades.
