Turbo purchase gone bad…need advice
There's no middle ground. Either the turbo was as represented, or it wasn't. If you assume all are honorable and telling the truth, then the turbo was defective when shipped, the participants just didn't know it. Under those circumstances, the seller should take back the part, and refund the money.
I saw Tony's car with the stock turbo on it and there was absolutely no problems with it. In fact, I was going to buy this very same turbo from him but I just did not have the funds at the time. Tony is a good guy and the fact that even the installer says he only noticed a problem after taking the turbo off leads me to believe that it was either not primed or installed correctly.
I would like to remind everyone that Tony and Mitsuorder have done more for the community than any single poster in this thread. I have no idea why they keep coming back when their efforts are not even rewarded with a little bit of slack.
In short, I have seen this turbo working perfectly on Tony's car many times. I would have bought the turbo had I had the money.
Mitsuorder's character is not in question here. Anyone from Texas will vouch for the guy, even a couple of people who don't necessarily see eye to eye with him. He doesn't get jack for being a moderator and he still puts up with this crap. Simply unbelievable.
To the buyer: So you got a turbo, did not inspect it, was not present for the install and you come here and start flinging dirt in everones face? I'm sorry that you're having troubles (I sincerely mean that) but Tony's turbo left here with a clean bill of health.
I don't see how Tony can give you a refund for something that left his hands in perfect condition.

Looks like you are stuck between a rock and a hard place. The way I see it there are two versions of the transaction. The only tangible evidence is the turbo itself, unless there is some sort of documentation of the turbo being removed and installed, i.e. video tape...
The best thing would be to work out an agreement between the buyer and seller. If that does not work out, small claims court is the best way to work out civil disputes, but based on the treads it is the buyer's word vs. the seller's word. Buyer has to prove the turbo was defective upon receipt, seller has to prove it was in good condition at the time of sale.

I think the only way this gets settled is through a nuetral 3rd party like an arbitrator. Before any of that can happen the turbo needs to be taken apart by a proffesional to determine the scope and cause of the problem. Until then it's just interweb banter and that usually deteriorates into legal threats, PayPal disputes, etc. Let's get an objective set of expert eyes on the internals of that turbo!

That being said, the only thing shady i can see happening in this transaction; is with the buyer, as NOBODY (except him) knows what happened to that turbo after it was received. As all we have is his word, while we have 3 or 4 other peoples word on the sellers end...
Just split it down the middle. Facts are facts; the buyer should be refunded per legal retail policy, though the buyer is the only one with a shady area here... So the money is split, DONE. glad i could solve this for you guys

To the OP I would send it out to FP or Buschur and let them make it green. You got a deal on it now spend a little more and have something even better then when you started.

So here's the situation:
Everyone that knows Tony and Josh, will always vouch for their characters. They are both two of the best guys you will ever meet and are so honest that it's almost a shame.
Josh is the only person (outside of AMS' Chris Black) that I will let even touch my car. He is that careful and he takes that good of care. You car IS his car when he's working on it. I have yet to see anyone in the automotive industry provide such good service on a car.
Tony's car ran great on the day of the AMS tune in Texas, and there were no problems then all the way up to when the turbo was removed.
All we have on the buyers end is that the turbo was received, uninspected, and taken to a shop to be installed--no witnesses of the install, or whether or not someone even could have dropped the damn thing. On the sellers end we've got character witnesses in addition to witnesses that the turbo did indeed work correctly up to the point of uninstall.
Personally, I think someone messed up their own turbo after receiving it, and is now trying to get someone else to pay up.

Don't tell me to Shut Up, so everyone needs to be quiet about there opinions but your's matters, whatever it is about the seller's... show me some factual info that it was damaged after it was recieved.
