First man start by re-reading what you are posting.. it is not even english. As for the car, you're going to have to sue, and if they towed it before you bought it you are **** out of luck.

why are you guys trying to pretty up this situation, thats really f'kd up. I think R&D should come out with a safe-mode module to protect the drive-train as it can be a very expensive mistake...

I would first start by talking with the tow truck company and explain to them what happened. It is a sure fire bet that your transfer case is toast. I would threaten them with a lawsuit and tell them you are already talking with a lawyer (even if you aren't) to show them you are very serious. They should be at fault due to negligence. On a sidebar it's actually kind of odd to see the tow-behind tow trucks anymore. All I see now are flatbeds. I hope everything works out for you.

You have a problem my friend.....

take it to the dealer....ask them what its gonna take to fix it.....take the estimate to the place that towed it and tell them that if they dont pick up the bill that your gonna get a lawyer.

.....Unless of course you cave them consent to tow it like that then your ***'d. but they should know before they get there with the truck what kind of vehicle they're about to hook up to and if it need a flatbed or not.

Dont even waste time trying to talk to the tow truck company if they show any resistance to buying you a brand spanking new TC. As soon as you see that their position is that you're SOL then you file a suit. Don't warn them, let them be surprised when they get served! If you try to get them to do anything against their will (like fix it) they will make you suffer for it and it will take way too much time and headache. ANd it will never be fixed properly. Go to court, win your case, CASH settlement = new tranny. And don't feel any hesitation or sadness about the way you are handling it because 100% they would do the same to you if they had a reason to sue you.

This brings up a very good point. Were you there when they towed the car? If you were, then why didn't you say something when you saw that they didn't bring a flatbed?

Good Lord, we live in 2007 each towing company should have a VIN scanner, which means he goes by the vehicle scan the vin and it says, AWD stay the **** out "flat bed only" ****ing *******s, GL getting your car fixed, all i can tell you tow copanies are pain in the rear and they wont cover **** for sure, so basicly you will have to pay out of your pocket or contact the insurance and explain what happened. good luck bro.
