help, getting toyed with by the dealer
sorry in advance for the long story but its the only way I can convey everything that goes on.
So i have had my evo for less than 5 thousand miles, and it was due for its 30k tune up. I took it to the dealer that i bout it from (a big nation wide dealer) and had it done there. Everything seemed all cherry but then about a hundred miles later i noticed that it makes a funny grinding noise from third to fourth and if i down shift from fifth to four. Even if i heal toe, rev match, ect. it is never smooth. So i took it back and they said they would look into it. Since they just did a tune up and i have a warrenty with them that covers drive train till 83k.
I have had friends say its a Synchro or somthing
I droped it off on tuesday and this is how it has gone down so far:
Tuesday- drop car off, they say its ok and they cant do it.
Wednesday- I have my parents go test drive it (since i work from 10-6:30) and my dad has never driven my car before and can get it to make the noise.
He almost **** his pants by the way driving it. They say they will pull it apart and look at it
Thursday- They are going to "Pull it" apart and look. but they had to take it to a mitsu dealer cause they didnt have the right oil. That seemed odd
friday- get a call at 8 am when i am sleeping and they guy says his daughter is sick and wont be able to check on it for me till monday. ok i can feel the guy. i can live with out my car for a while.
monday- dont get a call and then i have to call him by 4:30. all they did was switch the oil. and guess what it still does it. Now the guy says he is gathering info to present to his managers so he can figure out with the next step is.
So my question is: WTF?! anyone have any ideas of what i can do? the only way i can get it fixed hopefully under a warrenty they offerd me is to have everything done there. but they are trying to worm out of it and say it was me. Nothing on a car should die in 5k miles or 100 after a tune up. Any thoughts

Sold you a faulty vehicle. Don't let them toy you around.
Either:
1) Tell them to fix it in good time.
2) Return the vehicle and get your money back.
3) Hire a lawyer if it gets worse.

Lemon law only works if it breaks three times the same way. Why didn’t you take it to misu in the first place (it sounds like you took it to a big box dealer)? From what it sounds like fourth gear syncro is shot and maybe even fourth gear. It still should be under the factory misu warranty. If not it's 7 hours book time to R&R plus parts and rebuild look at spending $1500ish if you can’t get it covered under warranty.

If the transmission needs to be rebuilt go Shep, RRE, jackstransmissions etc. These cars have a bad reputation for being ragged on. it will be up to the GM of the dealership to make it right. If you are outside of 30 days from buying the car they can blame it on you. Regardless of what happened....a tune up doesn't cause a car to have a transmission problem...this is what they will say and they are right....the variable involved is if they sold you a EVO with a transmission on the verge of going out and/or an in-experienced tech drove the car and didn't know how to really drive a standard car (Believe me I know tons of techs that can't really drive stick well).
I hope you have no mods because if the car has one aftermarket part on it they will say they have no clue what was done to the car since you purchased it. They will re-iterate that the service you brought the car in for should not have killed the tranny. They will blame this issue on pure co-incidence.
I would be prepared to take this to the GM or owner of the dealership (maybe even mitsubishi themselves if its a mitsu dealership).
I've seen/heard of this all to often...someone buys a low mileage EVO thinking that its still a virgin and shortly after purchase the clutch/trans/diff goes out. Then they're pissed. A lot of times its not the previous owners fault. Its just the nature of the beast when it comes to a high performance AWD car. There were a lot of premature tranny /tcase issues.
I've been part of this site for a while and just recently bought an EVO on the terms that best suited me...I was looking for a really low mileage EVO and almost pulled the trigger on a few vehicles but I found one locally (my 3rd color choice) and the person selling it was putting it back to stock (He had it built to the hilt....2.3 AMS motor HTA35R etc) and was straight up on everything. He bought a stock motor from another reputable local shop and bought a turbo from a reputable vendor on here. Before he even put the car back together I had him send the transfer case and transmission to Shep......its been a long turnaround time but I didn't want to experience the issues you're having now and be *** out and have to spend more money.
I feel bad for you dude but being around dealerships a lot and I've found that they only car about moving cars off the lot and service (where they make most of there money anyway). They are worse then insurance companies when trying to get out of an obligatory service. Keep us posted.

I will keep everyone posted as to what happens. They are trying to stick me with it, but that **** isn't happening. I haven't beat on the car, never two stepped, raced, or any of that business. (I have worked hard to save money for this car and want to keep it nice) I have found 5 separate accounts of this issue happening in a 10 minute google search. odd?

Eh...I wouldn't even trust them (not like I trust Mitsu much more)
But 06 w/ 30k you should be under warranty. Take it to your Mitsubishi dealership and see what they have to say at least.

Sounds like the 3rd party dealer may have put the incorrect fluid in the trans and now there scrambling on what to do. Their likely going to get mitsu involved who is going to deny the warranty claim for one reason or another.
Your best bet is to speak to the 3rd party dealership to see if they will cover the repair through Mitsu

it went to the mitsu dealer and got the fluid changed and it still does the same thing. they said they havent ever seen this issue before. The only aftermarket part i have on my car is greddy ti-c catback exhaust. I dont think the exhaust will have anything to do with the transmission.
i feel as thought i am getting the ring around and i dont want to get ride of the car by any means, but only owning it for 5k and already needing new brake pads (already done) and tires. I just dont have any confidence in this company that "prides" them self on there "amazing" customer service.

What you will see (and people will chime in) is that the Mitsu dealership for the most part will find ANY reason to void your warranty no matter how crazy the relationship maybe....(tranny issues....aftermarket exhaust= no soup for you).
Ok,I feel for you bro. When it comes to this type of stuff all dealerships says the same thing, BS! They all want to sell cars but when we go back to get anything done no one wants to hear about it...

Oh, and if you paid extra for that extra warranty, welcome to the world of getting screwed over. Those extra extended warranties are crap much more often than they are useful.
Carmax FTL. I like how they have the dealership set up (keys on the windows) and how easy it is to test drive something there, but they aren't exactly the quality they say they are.Forget aftermarket exhaust, that makes it too easy for them. More like: You drove the car off the lot in a manner other than the way a grandmother would drive to get her grandkids home = no soup for you. Thank you for buying a rally inspired race car, that isn't allowed to be raced.
