Her insurance company wants me to show a receipt for the carbon fiber hood. The only problem is, that I don't have a receipt for it!

It might be possible the compnay might still have you on record for buying it. You could try contacting them.

Other than that it seems you might be getting a cheap replacement for it.

Or isn't the stock hood more costly? If so tell them you want a stock hood and use the cash to get a CF one.

insurance companies job is to pay out as little as possible.. Good thing you are alive, but you would be surprised from an accidents just like yours how you might have back and neck problems for the rest of your life, sometimes it may take weeks or months for them to come out. I would see an attorney so you could stand a chance from their insurance co

Yeah the stock hood brand new cost ~$1100. So if you wanted to you could tell them you want the money for a brand new stock hood, then go out and buy a cf hood which is like 800 or so shipped and pocket to rest or use it towards other cf goodies

Man I'm sorry that you had to go through all this teeth pulling...

What I find surprising is why your insurance company isn't doing a thing for you...

The insurance companies are there to alleviate all the stress it appears you went through.

Thats why we pay them $$$.

You should complain to your insurance and tell 'em that if they don't do their job, you're going to go look for somebody else...

I'm sorry to jump into this discussion so late, however it doesnt seem that anybody has given you any insight or advice into actually resolving this situation without personal input.

Evidence: Photos
Evidence: Police report (as indicated in the OP you state the officer on site determined guilt)

First off, the operator of the truck had valid insurance which insures her against damages caused by her negligence.

Secondly, There is a 99.9% chance that the other person's insurance company has verbiage containing requirements that the vehicle be operated in a safe manor and that it is the insured responsibility to maintain the vehicle to the safety of others on the roadway.

Third, and lastly, as you have suffered physical, and monetary damages from the fault of the insured (as proven by the police report), there is technically no reason the insurance company can not act in bad faith towards you in its desire to act in good faith towards its client (the at fault party)

Further described here: http://library.findlaw.com/2009/Mar/2/247362.html

What you should do is obtain A) at least three quotes for repairs from reputable shops B) a copy of the police report or the officers notes determining fault C) contact the at fault parties insurance company and send them a copy of the police report and the three repair quotes with a short letter outlining that they have 5 days from the date of submission of your fax to approve your car for repairs. If they fail to do so you will go through your insurance company who WILL cover the repairs (note: you will be liable for your deductable at the time the car goes into the shop, but the deductable will be refunded at the time the other insurance agency pays out the claim).

YOUR insurance company is happy to process your claim with the evidence of the police report as they will sue the other company for failing to uphold their rights to the insured. YOUR insurance company will have their legal bills paid for during the lawsuit and you will be out exactly nothing.

There you go. Have fun.... And now you know how to prevent an insurance company from commiting fraud to you.

For one she said the insurance finally payed out. And for you story I'm assuming your car was an automatic because if it was your evo it would of stalled instead of lunging forward. Insurance isn't really a joke. Insurance is basically you paying money for peace of mind that when something happens you're not completely screwed. $8,000 is alot better than $0

run out of gas????? mechanical error???? GET THE **** OUTTA HERE... running out of gas is human error, anyone with common sense knows to fill your car up when its even close to empty even though some try and test the limit. even if that was the case she hit you, her insurance MUST PAY OUT. if they don't its time to get your insurance company to throw a lawsuit on their asses
