The insurance company told me that they have yet to decide if that other girl is at fault, even with the cop being there saying directly to her, it was! so they will not pay for my car rental. They said, I will have to pay for it and if they find her at fault, they will reimburse me. Her company will not get back to her until Tuesday (of course, gotta love business days). I don't have a car until then I guess =(

Dude you need a new insurance company.
They should be fighting on your behalf just like her insurance is fighting on her behalf. How hard is it to read a damn police report?
When I got into an accident, my insurance company said it was the other party's fault, and their insurance said it was my fault. I had my truck fixed with no change in deductible long before everything was settled.
I'm guessing you don't have full coverage?
