Pissed off and tired of Body shop. Any suggestions?

Hello again EvolutionM, I has been encountering the worst problems for the past month now. I got in an accident on July 1st this year (other persons fault). I took it to a shop July 3rd and was promised with so much and turned out so little. I received $7,000 from her insurance company and I signed the checks over to a Collision shop here in Colorado Springs, Colorado.

Its been more than a month and every time I go into this Collision shop, My car looks exactly the same! The owner keeps telling me he ordered the parts and he is waiting for them.... Well I called the BS card and found out what company he ordered these parts. Come to find out, he never even ordered them.

It has been havoc and the Owner keeps telling me it will be done this week, then the next and so on and so on.

Please help for suggestion

i also found out he has been using my money to fix other cars, also took my antenna off and gave it to another girl who has an evo. A lot of petty stuff that should not be happening. I cant get the check back, because he already cashed them and from the looks of it, he spent all the money and cant even fix my baby!

Show up with the cops and threaten them that you will take legal actions. Dont call 911 actually contact the local sheriffs or police in the area and explain what is going on and ask for their assistance.

ask for your money back if they haven't done work, take your business elsewhere, hit em where it hurts, there income, thats what i would do

Your first problem is that you signed the check over to them at the start.

Most of out body shops here only get the check signed over after the repair is complete. But then again, most customers pocket the extra money and skimp on repairs,LOL.

Good Luck to you. You could try and contact the insurance company and complain too. Maybe they can help you get your money back.

Either way, get your car out of there.

A little confusing. Whenever I was involved in a motor vehicle incident, the insurance never cut a check unless the car was deemed total. But nonetheless, I would take some legal course. As the others have stated, get some proof and back up first, prior to calling the police,etc.

Dude i had the same problem with a local shop, i went to my lawyer and had the shop give me back all my money and i had them tow the car to another place which actually did an amazing job! so if i was you i would try and take your take out of there and get your money and go somewhere else!!! The police will most likely tell you that this is a civil matter. I would contact an attorney immediately. Most of them will advise you of what your next steps should be and it typically won't cost you anything. Get a signed letter from the attorney stating that you're requesting a full refund and the vehicle be towed to another shop of your choice or something to that extent.

You can PM me if you want specific information... but I'll just say I've been in this situation before and I was foolish, careless, and ended up losing out.

Contact an attorney IMMEDIATELY. If the police will help you, then by all means request their assistance. I'd contact the insurance company for copies of the checks or information that they actually signed the checks over or what have you...

Yes, I probably should have listened to you and took it to hanks. The collision shop I sent it to said they could fix it for pretty cheap and I would have a good amount of money in my pocket. That being said, sounded so promising, hence why I did it.

I was told to take the check to the collision shop and sign it over to them (Insurance company told me)

The body collision owner is a huge meth head, and I am guessing a lot of my money went towards his habit. When I talked to him about why he hasn't been fixing my car, he kept telling me, he is waiting on parts. I came to find out, he has another insurance job and he is waiting on that check to get my parts..... Which I am guessing he doesn't have any money in his bank account.

Small claims would be the best bet, but Its only a $5,000 cap, so I would be shorted by $2,000

Tell him you have consulted with an attorney on the subject and offer him a week to get it together or better yet, demand that he show proof of parts being ordered immediately, or you will take legal action and he will be hearing from both your attorney and the police. He could get shut down for that, its fraud plain and simple. If he has the ability to do so(as a body shop owner I would assume he does), that should get him to get his **** together. You can also contact the woman's insurance company and/or your own for advice. Good luck man, I hope it works out. Just the antenna thing alone would have me boiling!

Also, Would you happen to know what lawyer would handle a case like this, Any specific lawyer?

Look for one that specializes in insurance fraud. Thats a good place to get started. Also, if one attorney cant help you, they can often refer you or steer you in the right direction. For now you dont really even need to go that far yet, you just need to tell him you have done so and this is the last and final warning. Tell him straight up that insurance fraud is no joke, and thats exactly what he is doing.

Keep in mind also, that he can be sued for lost wages or any damages caused by wasting your time and interfering with your ability to have the use of your own car. If everything you have stated is true(Im not saying it isnt), this is a very big deal and he can get into deep ****.
