Bad paint job, now being sued
I was kind of in the same situation, but him taking you to court was the only difference.. haha. The guy did a horrible job on my car and before I could take him to court, he filed bankruptcy, so a big 0 for me. Good luck and make sure you have enough to prove in court. A Lawyer is never neccessary for a small claims, which in most states the cap is $5,000 (mine is $7,500 =) ).

There appears to be a TON of mis-communication here. why did you not point out their mistakes when you picked up the car? what was AGREED upon in the pricing? you might have thought they would fix everything for that price but that price might just be for paint. You waited a LONG time to bring up the fact that its chipping/peeling but during those months you didnt pay them so of course they are going to sue you.
you should go talk to them and see what is going on. from there go get some grown up advice, forum advice is not going to help. I was kinda in the same problem but whatever, the paint lasted forever, altho theres chips here and there and paint runs its ok. I doubt you will get money for the spoiler unless you have the receipt for it, more than likely they might just replace with whatever junk yard piece they can find. i dont know how u could afford a $1700 spoiler and couldnt go to a more reputable place. (not saying this place isnt, but from the sound of it...)

This probably lost you the case, this is absolutely illegal. You can't cancel a check after you sign off on it. Is like steiling their money. In a court room a check is like cash you can't cancel it. Best of luck though.

As far as the paint. It is totally unacceptable for paint to have chips, cracks, orange peel, pin holes, fisheyes, peeling, blistering, clear coat yellowing, color mismatch and or non blending, solvent pop, and runs/sags. The OP probably paid upwards or 2k for this, any defect in the paint is not just an eyesore, it is a huge problem. Paint doesn't crack and chip(excluding getting hit with rocks ect) for no reason. Cracking can be caused by many things but most notably by improper surface prep and non uniformly mixed materials. If you just dropped a few grand on paint and you are picking your car up it should look like nothing other one smooth even coat with no variations in color texture or otherwise. All paint defects are caused by painting wrong or prepping wrong and are totally unacceptable in a painted surface. these are supposed to be professional painters at a body shop, they know what a paint job needs to look like and it doesn't involve anything other than one continuous, even coat.
I don't intent to be cocky, but people need to know what to expect when shelling out so much for paint job. I would like people to be educated on paint since it is such a huge part of protecting your car. It looks good sure, but its purpose is so your body doesn't corrode, and its not doing that if it has defects. Its also not looking good if it is peeling. I paint jets for the military, its not so hard to get a defect free surface, I don't understand why body shops can never get it right.
Maybe so, but the shop also gave him an unacceptable product and refused to fix in a timely manner.

What world are you in? Factory Spoiler for Evo's are $1700.00 from the dealer... if they screwed it up they pay to replace it, and NO they cannot replace it with whatever junk yard piece they can find...
They didn't "refuse" to fix the product. They agreed that they would fix it "when they get it in". It's not illegal to cancel a check, but it is illegal to cancel a check to defraud a store/shop. Since the shop agreed to fixing the paint afterward, they can technically call this "fraud" in court. When you placed a stop on that check, you set yourself up for extra fees to be added on if the lawsuit goes in favor of the shop.
Actually it was at a very respectable body shop at a local chrysler dealer.
I used to work in an auto body shop and I told them when I dropped it off to make it perfect even if it took an extra month. So when I picked it up I was pretty shocked.
You really didn't read much. The OP said he pointed these out when he was told the first time the car was done. He said he went there and pointed out how they didn't fix everything he asked and how there was stuff wrong. The shop agreed to repaint, OP said they waited 1.5months and was not called so he took the car back and canceled the check.

Single advice for u bro, am sure u might already know that but I figured still give u heads up on that, get lawyer from the same city where u hearing is that will give u plus point. Lawyer from same city or county most Likely to know that judge. Good luck bro
