Factory Warranty
Factory Warranty
After reading many threads in here with respect to warranties, it seems a lot of ppl don't know their rights with respect to the factory warranty. Additionally, from what I've read on these boards, dealers are stepping way beyond its' rights to void the warranty.
First off, understand that a warranty is a contract between the buyer and seller. Technically speaking, only Judges can decide if a contract is null, or if aspects of the contract is voidable. So if you feel your rights are being violated. Talk to an attorney. Sometimes just a letter from your attorney is enough to resolve legal matters.
Anyway, back to the topic. With respect to modifying your vehicle, I just so happen to discuss this topic with an attorney friend of mine over the weekend(He represents dealers in legal matters). Essentially the jist of my conversation with him with respect to vehicle modifications, is that warranties are still binding as long as the modifciations made to the car are not directly attributable to the problem(s) the car encounters. ie. the cause of a warranty claim.
Obligatory Exculpatory Clause:
I assume no responsibililty for the above statements. Different states may and do have different laws re this. Take this with a grain of salt. If ever in doubt, seek legal counsel.
This is in no way legal representation on anyone's behalf. I'm posting this as a courtesy to my fellow Evo owners.

Sean, Huntington Beach mitsubishi is really mod friendly. Talk to Josh there. They wont dick you over.
The only thing that is not warranty covered is anything involving the engine being opened up (even cams). This being because when there is an serious engine problem, according to Josh there, they arent allowed to approve the work. MMNA sends a super tech over to look at your car, measure stuff like cam lift, etc. So, that's how its not warrantied because if you have a mod in there, they will find it according to Josh at HB.
Hey, check out SoCalEvo.net too!

What if...
...you go to
to get warranty work done, and they tell you to screw-off, then what? What kind of costs would you be looking at? Would you have to find a local shop full of cool guys to get the work done?
After reading all of the crap on this board about this topic, and the clutch crap, I think we all need to be looking at what the alternatives are now that we own the Evo. I didn't buy this car to have all kinds of problems, and a company that is unwilling to service someone who paid $30k +- for their product. I want to get the most out of this car, and if in the long run it is more financially feasible to just screw the warranty, and put in an aftermarket clucth (if needed), we should have all of the data to make the best decisions.
So what do you all think?

If 75% of cars have a problem. ie defective. thats roughly 5000 cars in the US. For arguments sake, lets each car costs $1000 to repair. That leaves mitsubishi with a 5 Million dollar liability.
5 Million is enough to get a few lawyers interested, wouldn't you say?
So, the final remedy would be a class action lawsuit. There's other steps before that though... Like everyone needs to file a complaint with the DHTSA.
...a class action lawsuit is the last thing anyone wants. Lets hope Mitsu isn't stupid about this.
