Are these struts oem?

Sounds like a strut possibly. Check the springs to make sure they aren't broken/cracked or anything and check to make sure the spring is seated correctly. Another thing to try is suspend the rear and take a big pry bar under the tire and pry up and feel how the strut/spring reacts. Checking it if feels weak or unsmooth, etc. Compare the sides to each other. Judging by your mileage and the fact you had tiens on it previously it sound like a strut. In theory the strut should not affect ride height but i have read in other threads that it can cause the problem.

Edit: The car hasn't been in any accidents or tapped any curbs or anything has it? Bent suspension components?

The car was in a small front end tap a really long time ago from the previous owner 10 mph into a snow bank (minor damage) and recently i was backed into in the rear left wheel i needed an alignment (minor damage) i just want to be certain the cars not bent in the back somewhere i looked everywhere took strut tower measurements

Replace tne struts with Bilstein MR struts. It will be much better.

I think its safe to say the car is ok and its in the suspension. Only other thing I can think of to try and its excessive is to swap the spring/strut assemblies and see if its lower on the left side then. Most cars they are the same but idk about the evo, I would think yes.

Edit: Just looked at this pics in your other thread they look the same so you can swap them side to side. Only other thing to look at is the spring seats and to make sure the spring is sitting properly and the strut rod isnt bent at all. Other then that I'm out of ideas.
