Cracked transfer case? Not going to be covered?

Guys.... Im Fighting this ..... effff this. As stated in the 2008 Evo Warranty on page 6
• Coverage applies only to the repair or replacement
of powertrain components originally manufactured
and installed by Mitsubishi Motors that are defective
in material or factory workmanship under normal
use and maintenance or Authorized Mitsubishi
Powertrain Component parts sourced from and
installed
"Non-authorized, aftermarket parts and/or Mitsubishi
parts not obtained from and installed by an
Authorized Mitsubishi Motors Retailer are not covered
by this warranty."
Doesnt say that they wont cover parts that they believe were damaged by after market parts. They have NO proof that my mods damaged the T-case. I am going to write a email to the Massachusetts attorney general. There has got to be something illegal about this! I dont like being dicked around and am fed up with this ****. From the day I purchased this car til now I have been treated like ****, and its frustrating!!!!

Hello, I have a question about an automotive warranty. I have a 2008 Mitsubishi Lancer Evolution which I bought brand new. It comes with a 36,000 mile Power train warranty. I recently noticed a Leak under the car, and took it to the dealer "Executive Mitsubishi in New Bedford, MA" The dealer had my car for a week and never got back to me, I finally filed a complaint with Mitsubishi Corporate headquarters, and the dealer got the car check in a rush and it was done the following day. It ended up being a cracked transfer case. The dealer is now telling me he will not cover this part under warranty because I have modified the car with after market parts. However, all the parts I have added do not directly effect the transfer case. This dealer also put a restriction on my warranty so I can not get this problem fixed at another dealer under warranty. This dealer also charged me an $85.00 fee because he said it wasn't under warranty so he had to charge me to check it. Now, I have read their Warranty information which is located at http://www.mitsubishicars.com/media/...ty_booklet.pdf .
On page 6 it specifically states.... " NOTE: • Coverage applies only to the repair or replacement of power train components originally manufactured
and installed by Mitsubishi Motors that are defective in material or factory workmanship under normal use and maintenance or Authorized Mitsubishi

Therefore in their very own warranty it states that Stock parts will be covered, which the transfer case I have is indeed stock, and is not affected by my modifications. So I would like to know your view on this issue before I put in a complaint through your office. As far as I read in their warranty this should be covered 100%.

The fact that the trans was out of the car is enough for them to not warranty a transfer case leak. Whoever did the clutch might not have replaced that o-ring on the t-case where it mounts to the trans. Or maybe the o-ring got damaged on assembly. If the trans hadn't been out of the car then you would have some ammo. Good luck tho.
