I also believe your statement about the ethics of using a lawsuit against the tow company to pay for an engine build is also correct. I do believe the OP should be compensated for this *hassle*, but his pics of the valve damage looks to me like he will be paying out of pocket ~5-7k ($ US) because he definitely pushed the limit of the stock block with 7800rpms + FP Red no matter how good his tune was.
But if he has the engine rebuilt while the dealer is repairing the trans, tc and diffs and he is using a rental car he's not paying for during that time period, that's the ethical limit of justified I think.

Just to make this clear. I have no intentions of making the tow company pay for my engine. That being said, its going to be hard to get money for time down and car rental, since the car would be down anyways because of the engine. All that being said, if i win any extra money, it goes towards fixing the engine.
I believe I was also very very lucky. I don't believe a forum is a place to judge the true nature of someone, I just felt sharing my story would help explain my stance and previous posts to anyone reading.

Funny, my sone almost bought a new 5.0. Its a lot of car for the money. Well, its really just a nice motor and it does not look too bad. He opted for something else. Glad he did.
Buy used stuff off forums and you won't be any where near what the dealer quoted. I remember when my seats were stolen in 05. Insurance gave me $6k, ended up buying some nearly new ones for $900. The extra went to upgrades and paying off other bills.
yes and no to pushing it, i know a lot of locals running the same power level as mine and more, they track them, drag, street them and none of have blown motors. not to say they couldnt blow them. im just saying 8k rev limit is pretty common here in minnesota with stock block/head. I'm set at 7600 and mine drives like stock yet. OP what dyno did you use?

havent been on a dyno at all. Been tuning with Clipse and using Tactrix/ECUFlash/Evoscan and VD just to compare each run.
But your post hit the nail on the head. I thought it was due to over reving but nobody seems to agree. Which brings me to the question...wtf happend. If it wasnt over rev then maybe detonation?

Detonation could chew your plug up like that, and then plug bits could chew your valves up. It's very possible

Yea sue them for more then parts and labor. Tow companies should dam well know by now that AWD vehicles have to be flat bedded. Its rediculous. They can pay to fix your car. They can put you in a rental vehicle. They can also apologise for their stupidity and give you a few extra bucks for all the nonsense. They arent just going to say oops i'll fix it.
