Body shop problems

Dont know where to post this.........

My car been in the shop getting painted for the past 6 months. The owner told me it should be out in about 1-2 months.... but him been lazy and all that bs he dint keep his word. Also his shop is gettin closed cuz he is 3 months late on rent. So last monday we took my car to another shop that he recomended, and he said he would help out finish the car the way we had planned. Also that shop said the car would be out yesterday. But no, car still in the shop. Now my question is, can i file a lawsuit and get my money back? or what should i do?.......... So far the body is sanded down and some door jams are painted....but the doors,hood,trunk, front bumper,side skirts and rear bumper are still not sanded or been touched....also the paint job price was $2500 but i paid him $2250 and he agreed on it.

You paid before the work was done? I'm sorry that was a bad move. Have you been corrisponding via email with them or over the phone? If by email then you could have a case where you have proof of a verbal contract. Most states do not honor verbal contrats and if they do only up to a certian amount. If you can show payment and you have proof of that contract you can argue that a refund or partial refund is needed.

If the auto body shop goes bankrupt you might have more difficulty. Lawyer up.

So you paid up front and went to the shop that the person who didn't do your job recommended? That sounds like trouble.

not even 25% reliable... don't believe in those commercials you see on tv... i was charged $90 instead of $9 at some store. i called the CC company (american express) and they said its best to go to the store b/c you would have to file some papers they send you and would have to wait. i just ended up driving back into nyc to get it... its happened to me before with bank of america


but yeh, NOTORIOUSLANCER. if your gonna file a lawsuit do it before any major work is going to be done. .. even if you win the case you will still be responsible to pay for work done.

damn.. then yea pretty much im f'd then. I paid cash.... halfe at 1st then gaved him 700 to hurry up and last week i gaved him 500......and for the last 500 i forgot to ask for recipt, and dint get no contract or anything like that..... Then also i call the painter on his cell bunch of time and he wont answer till later.

.......just got the new shop number and i talked to the owner and he told me the car is almost done that it took longer cuz the front bumper and the hood where still damaged(something i tought was fix already) but he told me for sure friday or saturday the car should be out................... i just hope so cuz i miss my baby and now gonna suck cuz i was gettin my interior done but startting school next week, imma need to pay tuition an all that stuff 1st....

wow man ur lucky. If he wasnt an *** he cuold have ran off to another state or argued his way outa court. If you culdn't prove that you paid him for that job then it would have been baddddd.
