Question regarding passing a Smog Check

here is a picture of it....
see how theres piping, then the mas, then the filter?? oh and below that to the left of it, on the right side of the valve cover there is the breather filter, instead of the vacuum hose which connects to the intake

I thought it was the seller's responsibility to get it smogged within one month of the sale. The buyer may offer to have it done themselves, but if it fails the sale is void.
