from my experience, which i guess it depends on the state, the cost of repairs has to be greater than the value of the car. my parents just totalled out a '01 expedition with 10k in damage and they said it was only worth 8k.

It allows the not at fault party in a accident to receive compensation for the diminishing in value your vehicle took just for the fact that it was in an accident. Since you vehicle isn't worth as much as it was before the accident for the pure fact that if you went to sell it it says on carfax that it was in an accident. You would receive the difference of what you would be able to sell it for pre-accident and the amount you would be able to sell it for after the accident. Definitely Google it and read up as you may be entitled to at least a few grand in check form from the at fault parties insurance company.
