It's just really a grey area on the law books, there's no certain % that will get you a ticket, all it says is substantially blocking interior or exterior.. The COP is just being a ***** and picked on you.

If a police constable cant see inside your car during the day.............its too dark.

Why is the police constable being a ***** for doing his job?

All the officer has to do is prove he couldn't see inside your car.................. you have to prove that he could. But good luck.

What did you do to get pulled over in the first place? All tickets no matter how insignificant affect your insurance, especially if you had a ticket within the last 3 years. Really it all depends on your insurance company, how lenient they or on vehicle/ non-moving violations.

Because the law has NO set number for tints, it's all up to the officer, 5% should be illegal, but 35%? And he is spending taxpayer's money driving around looking for 35% tints and give them a ticket.. There are speeders, car thieves, and all he did was to sit around and give tint tickets.. He can give you a ticket for having stock glass, he decides if it's a damn violation.

I did nothing. Im on my way homewith my grandparents i saw him on the other side and i looked at my mirror and saw him made a u turn. And he pulled me over, Gave me a ticket for dark tint. I told officer
That the guy that did my tint told me that 35% is legal.

Ohhh, officer told me if i get rid my tints on the front i can just go to office ( cant remeber the office name) and show a picture of my car that i took them off on my car, 99% they would just let me not pay the ticket.

Why would i take them off if i know its legal.

Yea that definately sounds like the damn government trying to get some more money out of us. I have had 20 percent on my car for going on 5 years now and they have never said anything about that. Its always either been speeding or "excuse me sir but your car is too loud" its all just a bunch of bs if you ask me

Only moving violations affect insurance. This is an equipment ticket, and won't affect rates.

For what it's worth, here is what the HTA says:

Colour coating obscuring interior

(3) No person shall drive on a highway a motor vehicle on which the surface of the windshield or of any window to the direct left or right of the driver's seat has been coated with any coloured spray or other coloured or reflective material that substantially obscures the interior of the motor vehicle when viewed from outside the motor vehicle. R.S.O. 1990, c. H.8, s. 73 (3).

Windows to afford clear view

74. (1) No person shall drive a motor vehicle upon a highway,

(a) unless the windshield and the windows on either side of the compartment containing the steering wheel are in such a condition as to afford the driver a clear view to the front and side of the motor vehicle; and

(b) unless the rear window is in such a condition as to afford the driver a clear view to the rear of the motor vehicle. R.S.O. 1990, c. H.8, s. 74 (1).

Application of cl. (1) (b)

(2) Clause (1) (b) does not apply to a motor vehicle that is equipped with a mirror or mirrors securely attached to the motor vehicle and placed in such a position and maintained in such a condition as to afford the driver, otherwise than through the rear window, a clearly-reflected view of the roadway in the rear or of any vehicle approaching from the rear. R.S.O. 1990, c. H.8, s. 74 (2).

In other words, all windows to the rear of the driver are open season to tints of any amount. The front windows cannot be so tinted that they obstruct, in essence, anyone (cops) from identifying you at any time.

Almost forgot: to fight this, take a picture of yourself in your car, windows closed, in your normal driving position. One in the day, under natural light, then one at night with a flashlight to your face THROUGH the tinted glass. Prove you can be seen/identified and you prove your tints aren't too much. Use a dslr camera for this so you can set it to 400iso, and use the same shutter speed for both pictures, auto aperture. This assists your case by showing you did not fake or alter the images to enhance your cause.
