Damn! I hate to see your ride get torn up man. I know you've put a lot more than just money into it. Don't bother with small claims court, you're medical bills are going to surpass 6k and that seems a little on the high side for small claims. I hate to say it, everyone hates lawyers for it, look on TV and get one of those cheesy lawyers that settles cases out of court. They're practiced at settling claims with insurance companies and such. After you get fully assesed at the hospital, find out how much it will cost in long term care as well, factor all that in when it comes time for the medical bill. Now for the bad news, you can't put the RRM kit on your car with the insurance estimate money, they are paying for exact parts and they expect those exact parts on the car. If you put an RRM kit on there with the insurance company's money.... YOU are going to be the one getting sued! The only time you can use the insurance money to put on parts other than what's specified by them is if you outright OWN the vehicle, title clear and in your hand kind of own. Don't worry though, with the medical settlement you can do what ever you want with it, like buy a used EVO or a new EVO IX! Take care of yourself first though, what good is it to own an EVO if you're paralyzed from the waist down, they don't make automatics.

if he hit u at 35 mph... you should be able to get what you want... including extra money for the pain... and can sue for the loss of a 83,000 dollar contract if he was the cause of it.

Why didnt the airbags go off?? Thats like the 4th Ralliart Accident that the bags didnt go off..... Is there a potential problem with the system?
Airbags DO NOT go off in rear end accidents (it explains when airbags do and don't go off in your manual which I admit, i've never read either ha.)
But that really sucks. I guess the only good thing is that the car was hit dead on. If it was hit only half on, half off, it would definitely be totalled. Good luck with everything, car accidents are always a huge PITA.

If he hit me, I'd ask him to back up. Then I'd attempt to get the truck open. Thereafter, I would absolutely pound the everlivin' **** out of him with the tire iron.

I hate old people. I plan on killing myself at 40 so that I don't become one.

I am not sure about killing yourself part, although I would seek legislation that would make driver 60+ have to do the same things a 16 year has to do to get a license. Also they should put them all in really slow cars, and for the few old farts that want to drive fast we should give them a track day or something.

why would u need him to back up when you can easily open the 60/40 fold down rear seat and grab it unexpectedly.

Darn the old people and their beastly damage causing land yachts

I personally think you should have to re-earn your license every 10 years. In addition, I think it should be much, much, much harder to earn.

Make a time limit for parallel parking.

Make people weave through cones at high speed to exhibit car control.

Make a purpose built facility with traffic signs/warnings that change for each driver that goes through. This would make it unnique to every person. Take points away for failure to keep moving in a keep moving. Take points away if you get passed on the right while cruising on the highway. Make it more exspensive to get. There is an unfortunate corrolation to braincells and anual income.

Women aren't better drivers, they just take less chances and try less stupid crap. Every collision I've been involved in has had another woman behind the wheel. ALL 5 times. You could say women are safer drivers, but no better.

Defensive driving is garbage. They could sum the entire class up with, go slow and be unconsiderate of others.

The system sucks.

Do not settle this claim! Make it very clear that you want long term damages. Your back and your GFs shoulder are going to take time to heal and may not be the same ever again.

Most of the time, when there's an opposing insurance company involved, they'll leave it up to you to take care of the repair. They'll get an estimate for repair and cut you a check. IF you don't like the estimate, get your own and tell them "no, I don't care IF MAACO can do it for $750.63, I talke to 4 other shops that are telling me over $10K" once you've "agreed" on the price, you can do what you want with the money. But that's just for the car repair. Your medical bills are gonna suck *****. Worse, your medical insurance is going to deny the claim because it's an MVA. So then you have to squeeze the cash outta the other guys insurance co (again, providing this a$$hat even has insurance). I'd strongly recommend a good lawyer (and yes, maybe a greaseball that deals in squeezing insurance company ********)

You really should get a lawyer. My mom and brother were hit by old people and there insurance company was giving them a bunch of crap... It ended up taking a long time to get the money but the bills were covered and my bro ended up getting like $8000 cash... lawyers will take a chunk but if you were injured you should get something out of it... especially if you are missin out on all that work... get better man

WTF!!!. Jason I'm sorry to hear what happened to you. I'm sure you've read all the replies showing support for you. I haven't been checking the threads lately but damn I never thought I would hear one like this and from one of my boys. Hey if there is anything I can bro', u know where I'm at and u got my #. I hope u get better soon and the car is just a thing at least you and your girl are alive and that's what counts. Since I'm sure you know people here in FL drive crazy and not often do you hear of people surviving car accidents down here.

Thanks again guys. I had some friends reffer me to a good local injury lawyer. no one seems to know any good orthopedic doctors, but lawyers are usually good in helping with that, too. I think i might need to see a chiropractic (sp?) doctor, too. I know these things take time. My gf was in an accadent 2 months ago (also rear ended) and she still isnt feeling better, but she made alot of mistakes with the billing and got bills on her insurance instead of the other guys. having it happen again didnt help the situation. other relatives were in accadents years ago and still have pain. I just hope this doesnt turn out like that.

thanks man, I'm just glad it was on glades road and not i95! scary part is that if it happened 2 mins down the road, i WOULD have been on i95! its really a pain in the a$s, but im just glad im doing well enough to still know what pain is. ur right, these things down here usually end up worse. i'm lucky in an odd way
