**** man this sux. I hope everything turns out good at the end. Sorry to see another RA get wrecked. There should definately be a law that would require people over 60 to take their driving test again. This kinda stuff just happens too often. I personaly know some people that have been vistims of having old people crash into them. Take care, hope everything turns out good. PEace
update: i got to see the car today in the light and /wout having a road full of angry drivers swirving around me. its not a total and the under body isnt quite as bad as i though, but its still gonna need significant work. the rebar REALLY did its job and a bulk of the punishment, but it pushed its mounts pretty deep into the drunk body.

I hate to say it, but you really shouldn't be driving this soon! It looks bad for a high dollar settlement, and if you get rear ended again... Dude, I don't think anyone on the boards wants another Steve Hawking. Take it VERY easy, you might end up having a muscle spasm and running off the road or worse, into another car. It's not too late to have someone else start driving you, you can drive later on when you know you're 100% up to it. You allready know what happens when you gamble, the longer you play, the more you lose! This is why your company has short term disability! I don't know exactly what you do, but is there ANY way you could tele-comute? I'm just thinking like the insurance lawyer here but, if you can drive you must not be too hurt now can you? That's not me talking, that's a lawyer, understand? I've been hit so many damn times and not sued that the next poor schmuck that hits me is going to be paying for a very long time! I have serious back and neck pain daily. Long hot showers help, but don't heal. Which reminds me, have you tried a product called Absorbine Jr.? It's like Icy hot without the burning. It's been around over 100yrs and works better than it has any right to! The ingredients read off like a recipe for absinthe (nice) but you won't halucinate. It really works for me and my brother the comercial concrete laborer. If it works for a guy shoveling concrete from 1 pile to another all day long... It works on me too. Give it a try, but keep on the meds! It's a temp. relief thing. Sorry for the sermon, but I'm trying to look out for you. Bad wrecks haunt you worse the older you get. Young guys (under 25) bounce right back, but it will catch up to you around 30 if you don't get it taken care of now. Try not to rely on the Chiropracter too much, their business is LONG TERM. They want you to feel better, not your best. PT's are the way to go, they want to never see you again and vice versa! j/k There's a reason they make that much, because it works. Anyway, just be carefull out there, another wreck can cause major damage to your weakened system.

As far as taking a rental... Shouldn't really matter... A Lancer Ralliart and 2 injuries in the car is not really considered a "high dollar settlement"...
The thing you have to really watch for you if you're thinking it's totaled is "open items"... from the end of your front doors to the rear is open right now until further inspection or tear down of the veh...
As far as being upside down on your loan... If it is a total you probably will be if you have no GAP & haven't really been throwing extra money at the loan... Unless you put a fat stack of cash down for the down payment...

i needed to get the rental to get the doctors tomorrow. i think prolonging treatment is the worst thing i could do. i have the tow company give me a ride to the rental place, which was right next door to the place that is fixing the car. the tow place was just around the corner. so i got all the paper work done while on the block to save me from having to be out more than i needed to. i was on muscle relaxers and anti inflamitory medication at the time, so it didnt feel bad, but i paid for it when i got home and that stuff wore off
im taking it easy from now on.
the lawyer office guy stopped at my house and we got that process started and they hooked me up /w a good doc just down the road from my place. i'm in tomorrow in the AM for an initial visit. the insurance co already tried dicking me over, so im not even dealing /w them anymore. wanted me to pay my $1000 deductable for someone else's accadent. HA!
and the car isnt a total, and i dont think it will be a huge dollar case. im still a young guy and i know i'll prob be able to bounce back fast, but ur right. these things do catch up. i'm only 23 and my highschool athletic days are already paying their toll.

I have health insurance. the auto damage is fully covered by the other guy's insurance, but in FL, the PIP on your insurance covers 80% of ur medica. does the other 20% go to the other guy's insurance, or to your own medical? if it goes to my medical, do i have to pay copays and such (I have a PPO)? Can i submit copays to the other guys insurance? this part is confusing =)

The PIP that is not covered by your insurance company should be covered by the clmt's liability coverage... IF that's not the case you may have to pay your co-pay, but be able to subrogate the other person's carrier to recover your out of pocket expenses...
Also deductible is going to be charged to your by your ins. co.... That's the portion of ANY claim that you're responsible to pay... That's regardless of fault... However, if you do pay your ins. co. (since you're not at fault) should try to subrogate the other parties carrier for this amount...
Even the atty most likely won't be able to get your carrier to waive the deductible!

thx for the advice. i think FL is a bit of an oddball state and im learning the system slowly (but hopfully not the hard way). In FL, we have 2 deductables: collision and comprehensive. If you collide, you pay that deductable. if other damamge is claimed, you pay the other dectable (IE: glass breakage, telephone pole falls on car, gets keyed, etc). Those coverages only cover YOUR property and they are optional. Every diver must have 2 things: PIP (persional injury protection) and $10,000 liability. the PIP covers you medical expense only. the liability covers other people's property and their medical. There is no deductable with these.
so in my case, the other guy's liability is covering my car repair and my deductable doesnt get hit. My PIP covers my medical up to 80% through insurance and the other 20% is waived (ins cos never pay doctors list price). Then, my ins co sue's the other guy's ins co to cover the PIP fees. this just saves me from having to get involved. With both my car and my health, i can go anywhere I want: there is no 'network' you ahve to stay in because you cant pick who hits you.

As far as PIP goes from what I understood (I handle only IN, IL, WI, MI and OH claims) PIP will only cover Personal Injury... I thought the policy should also have a PPI which is Personal Property Insurance... Which would cover your property...
This carries it's own limit of liability (the total amount of which will be paid out)...
So you should be able to collect seperately for property & seperately for medical....
Which means they can't claim their limits if both reach a certain amount...
They can't combine payment for medical & property...
So if someone has a $10,000 limit policy property would have to come to $10K AND medical would have to total $10K each before they can state they've exhausted their limits...
Shouldn't come to that from what you've stated, but just a lil info for you...
